MORE COUNTRIES ADOPT THE UNCITRAL MODEL LAW ON CROSS-BORDER INSOLVENCY
|
|
Most recently, Brazil has adopted the UNCITRAL Model Law on Cross-Border Insolvency, joining over 50 jurisdictions around the world. Representatives of foreign insolvency proceedings may now seek recognition of such proceedings in Brazilian courts under the familiar rules of the Model Law. The new law amending the Brazilian bankruptcy statute and implementing the Model Law took effect in January 2021. The rules implemented in Brazil give broad discretionary power to Brazilian courts to grant relief in ancillary proceedings and bring some peculiarities related to Brazilian law in general. This is a relevant step to the Brazilian bankruptcy system and the cross-border insolvency practice.
