ONTARIO REALTOR® WELLNESS PROGRAM (ORWP) UPDATE

Vote to revoke mandatory participation in the ORWP – and end the program – defeated at the OREA Special Assembly Today

This morning (Wednesday, November 29, 2023), a special meeting of the OREA Assembly was held at the Westin Harbour Castle in Toronto where a key vote – that would have revoked mandatory participation in the Ontario REALTOR® Wellness Program (ORWP) and effectively ended the program – was defeated. The OREA Assembly voted against the motion 73 to 59, with 29 abstaining, which means the ORWP will take effect on January 1, 2024.


The OREA Assembly is comprised of voting delegates from each of OREA’s 29 Member Boards/Associations, and votes are allocated based on the number of Members belonging to each Member Board/Association.


With the most recent survey results showing that 63% of RAHB Members do not support the ORWP, RAHB’s three Voting Delegates voted in favour of the motion that would have put a stop to the mandatory ORWP. RAHB’s six votes were among the 59 ballots cast in favour of ending the program.


In the lead-up to the Special Assembly, nine Ontario Boards/Associations enlisted Framework Analytics to conduct an unbiased sampling of Member views regarding OREA’S ORWP. The survey was open from October 17 to November 10, 2023, and all RAHB Members were asked to participate.

The Framework Analytics survey results were presented to the leadership of all nine Boards/Associations. Additionally, a RAHB-focused presentation to the Board of Directors took place on November 24, 2023 focusing on RAHB-specific and aggregate results, as well as the reliability and representation of the survey sampling.

Dealing with a Self-Represented Party (TRESA)

SUMMARY:

Effective December 1, 2023, all persons involved in a real estate transaction who are not clients of a brokerage are to be considered “self-represented parties.” REALTORS® can satisfy their obligations regarding self-represented parties by doing the following:


  1. Verify that the party is or intends to be self-represented.
  2. Provide and explain the content of the RECO Information Guide and the RECO Information and Disclosure to Self-Represented Party form.
  3. Use best efforts to obtain an acknowledgement that the Information and Disclosure to Self-Represented Party form was provided.
  4. Only provide assistance that is:
  • A service provided to or incidental to a service provided to the client;
  • In the best interests of the client, and;
  • Consistent with the client’s instructions.

Note: The assistance must meet all three criteria.

Important Update on TRESA Phase 2 Compliant Standard Forms

There is an important update on CREA WEBForms® and OREA’s TRESA Phase 2 compliant Standard Forms implementation. As you know, TRESA Phase 2 comes into effect on Friday, December 1, 2023.

 

As of December 1, out of the total OREA TRESA 2 compliant Standard Forms, 122 forms will be live on CREA WEBForms®. However, not all new and updated OREA Standard Forms will be available in a programmable format that members are accustomed to by this date.

 

Members will be notified within CREA WEBForms® of the 93 forms, pasted below, that will not be live by December 1. These forms have been assigned a priority based on member usage and will be available when programming and testing have been completed.

 

CREA will keep members informed through a pop-up message on CREA WEBForms® and a dedicated landing page within the CREA Learning Hub.

 

CREA understands this may cause some inconvenience for members. Please relay any calls or emails to their Member Experience Centre by emailing support@crea.ca or direct them to the CREA Learning Hub.

Last week, in a surprise twist, Hamilton City Council voted down the incoming Vacant Unit Tax (VUT). RAHB has been advocating against the VUT and welcome the shift in Council support for the tax. It isn’t necessarily scrapped yet though. Council will have an opportunity to reconsider it yet again on December 13.

Earlier this year, the City of Hamilton passed a by-law requiring licences for short-term rental operators. Licensing application intake begins on December 1, 2023. Enforcement of the by-law will commence on January 2, 2024. With the short submission window, RAHB recommended operators impacted by the licensing requirement start their applications as soon as possible. You can find the application and fee schedule HERE.
