REMINDER: Operational Directive in Effect
Hello Family Reunification Partners,

As a reminder and FYI, that the ORR Operational Directive regarding background fingerprint checks for adult household members is still in effect.

According to ORR Policy Guide, section 2.5.1, adult household members of any sponsor category do not require fingerprint background checks unless:
  • A public records check reveals potentially disqualifying factors under ORR Policy Guide, section 2.7.4.
  • There is a documented risk to the safety of the UAC
  • The child is especially vulnerable
  • The case is referred for a home study (therefore, ALL adult household members are required to complete background fingerprint checks).
Those cases meeting one of the enumerated criteria above will require fingerprinting following standard ORR policies and procedures. Please note that all potential sponsors still require fingerprints.

Additionally, ORR may use its discretion to release a UAC pending receiving a Category 1 or Category 2 sponsor's fingerprint results, provided all other sponsorship requirements are met and there are no indications that there are risks to the child, the child is not especially vulnerable, and the case is not being referred for a home study.
