Marseilles resident Brad Miller stated that with election season he felt everyone should be reminded of the City zoning ordinance relating to political signs.

The ordinance is as follows:

4. Definition of Political Message Signs

A political message sign is a sign, other than a political campaign sign, expressing a noncommercial message regarding ongoing issues of political or public concern.

5. Size

Commissioner Scheib: Stated the sanitary sewer lining on Illinois Street is continuing October 19th. Lincoln Street Bridge deck over Gumm Creek is completed.

The concrete work for the sidewalks for the Safe Routes to School Grant has been completed. Contractor is working on landscaping and seeding.

Commissioner Buckingham: During the council meeting, Commissioner Buckingham addressed questions and public discussion regarding gravel used for concrete work at his residence. Buckingham stated that he hired a foreman from Davis Concrete to complete the work outside of regular business hours on a weekend and that the contractor had authorized the use of the gravel needed to complete the project. He also stated that he had obtained the necessary permit and paid for the work.

Questions were raised regarding whether the gravel belonged to the City or the contractor. According to statements made during the discussion, the contractor subsequently removed the remaining material. Buckingham also stated that law enforcement determined there was no theft because the contractor had authorized the use of the gravel.

Past Practices Regarding Contractor Work

It has been common practice for residents to hire contractors already working in the community to complete additional work on private property, with the residents paying for the extra work themselves. For example, when NICOR contractors were replacing gas mains and sidewalks, some residents arranged for additional sidewalk replacement at their homes. The City also amended its ordinance at that time to increase the reimbursement available to homeowners.

During the discussion, Mayor Hollenbeck explained that contractor bids typically account for the materials and equipment needed to complete a project. Contractors may order additional materials to avoid delays or the expense of making additional deliveries. Any unused materials may be returned to the contractor's facility or otherwise handled according to the terms of the contract and applicable requirements.

The ownership and disposition of leftover materials can depend on the specific contract and project arrangements. The discussion highlighted the importance of understanding those arrangements when questions arise about materials used during public projects.

City Council meetings are livestreamed and available for public viewing on the City's YouTube channel. Residents are encouraged to stay informed by watching the meetings and hearing the discussions directly.

The City values respectful, professional communication among council members and appreciates the public's continued interest in local government. Allowing each speaker the opportunity to address the council without interruption helps support productive discussions and maintain public confidence in the City's decision-making process.

Contract Review

The City Engineer reviewed the project contract and specifications to clarify how aggregate base material used in sidewalk construction is measured and paid for.

The project plans specify where two inches of Aggregate Base Course, Type B, are required beneath the sidewalks. The pay-item list on the same plan identifies the aggregate base course as being measured and paid for in square yards. The item number, 35101582, references Section 351 of the Illinois Department of Transportation (IDOT) Standard Specifications. The City Engineer provided the applicable specifications, highlighting pages 164 and 165, which explain that the aggregate is measured in place and paid for by the square yard.

Under these specifications, payment is based on the material incorporated into the completed work, rather than on unused piles of gravel delivered to or stored at the project site. Based on the engineer's explanation, material that has not yet been incorporated into the project remains subject to the applicable contractor and contract arrangements.

The contract review provided additional information to help clarify questions raised about the gravel used for private concrete work. When questions arise regarding public projects, residents are encouraged to contact City Hall or the City Engineer for clarification and to review the relevant project documentation.

The City recognizes that public concerns deserve clear, accurate information. Reviewing the contract and consulting the appropriate professionals can help address questions and prevent misunderstandings before conclusions are drawn.

Mayor Hollenbeck has been asked about work being performed south of town on Constellations property. Transparency by the City is important. The following is a statement from Ryan Tozer the City’s public information contact.

Good morning, Mayor Hollenbeck.

Below is the update on the old Coyle property.

Constellation has received Nationwide Permit 57 from the U.S. Army Corps of Engineers to clear trees for future electrical lines and a substation. A temporary fence has been installed to prevent soil erosion and sediment runoff. In late October, Constellation will conduct a required archaeological investigation to identify any historic or cultural resources on the site.  No construction activities are planned for the next ~12 months, as we continue to perform due diligence, evaluate the project's feasibility for a possible future project, and market the area to potential customers.
