Compliance: Rule Revolution Reminders

The Consumer Financial Protection Bureau has a summary of interim and final rules changes. Final Rule topics include the Fair Credit Reporting Act Disclosures on November 27; Regulation Z (Truth in Lending) Screening and Training Requirements for Loan Originators on October 31; Consumer Leasing (Regulation M) Annual Threshold Adjustment on October 30; Truth in Lending (Regulation Z) on October 30; Home Mortgage Disclosure (Regulation C) on October 10; Availability of Funds and Collection of Checks (Regulation CC) on June 24. Nacha has four operating rules changes coming in 2020. March 20, the Same Day ACH single-transaction amount increases to $100,000, up from $25,000. Repurposing return reason code R11 with a meaning of “error” goes into effect April 1. Effective June 30, the Supplementing Data Security Requirements enforce encrypted storage of electronic account information by non-financial institution originators, third-party senders and third-party service providers. Beginning July 1, all financial institutions utilizing ACH will be required to register contact information in the ACH Contact Register.
