Comcast is suing to block a new Washington law imposing sales tax on advertising services, imperiling a financial linchpin lawmakers relied on to balance the state’s budget.
The cable giant contends that the statute set to take effect Oct. 1 violates federal law because it does not apply the tax to all advertising services in the same manner.
Attorneys for the corporation also assert that parts of the law are not allowed under the federal Internet Tax Freedom Act, which bars states from imposing “discriminatory taxes” on electronic commerce.
“Almost all forms of advertising conducted over the Internet are subject to the tax, while most forms of advertising conducted off the Internet are not subject to the tax,” they wrote.
If Comcast succeeds in getting the tax overturned, it could force major recalibrations in the budget.
Striking the tax on advertising services alone would reduce tax collections by roughly $475 million over the next four fiscal years, said Mikhail Carpenter, a spokesperson for the state’s Department of Revenue.
The lawsuit filed in Thurston County Superior Court on Sept. 9 names the state and the Department of Revenue as main defendants.
Department of Revenue officials are reviewing it with legal counsel, Carpenter said.
The fight centers on a section of Senate Bill 5814, a major expansion of business taxes passed by the Democratic majorities in the House and Senate in April and signed by Democratic Gov. Bob Ferguson in May. Republicans in both chambers opposed the bill.
This bill is counted on to raise roughly $1.1 billion in this two-year budget and $2.7 billion over four years, much of it by charging the retail sales and use tax on more services, such as digital advertising, security services and temporary staffing.

Proposed 2026 Workers' Comp Rate Increase

TUMWATER − The Washington State Department of Labor and Industries (L&I) is proposing a 4.9 percent increase in the average hourly rate employers and workers pay for workers' compensation insurance in 2026.
This increase would help cover the rising cost of providing benefits when a worker is injured in the workplace. The proposed increase is less than what L&I projects it will need to cover 2026 claims expenses. As it has done in previous years, the agency plans to use the workers' compensation insurance contingency reserve to cover the difference.
If adopted, the increase would increase the cost of coverage by about $1.37 per week for each full-time employee, on average. Employers pay about 75 percent of the premium and workers pay about 25 percent.
"We always seek a balance between keeping up with the rising costs of providing wage replacement and health care benefits to injured workers, while keeping rates stable and predictable," said Joel Sacks, director of L&I.
By maintaining a robust contingency reserve through careful and consistent management of premiums paid by workers and employers, L&I can cover part of the costs rather than approving higher premiums for employers and workers.
Without this reserve, rates could increase by nearly 13 percent to cover the cost of 2026 claims.

Don't Open Your Door to Fraud
Beware of Paving Scams Ripping Off Consumers in WA

Fraudsters claiming to be legitimate contractors have been knocking on doors soliciting paving work around the state, according to the Washington State Department of Labor & Industries (L&I), law enforcement, and the Better Business Bureau. These scammers are notorious for doing shoddy or incomplete work, overcharging customers by thousands of dollars, and then disappearing when the customer tries to follow up.
In recent weeks, paving scams have been reported in King, Pierce, Skagit, Clark, Snohomish, and Grant counties. Some consumers have been swindled out of thousands of dollars.
Many of the door-to-door pavers are not registered with L&I, which verifies registered contractors have liability insurance and a bond, and meet other requirements. Unregistered contractors leave consumers with little financial recourse if there are problems.
How the scam works
Typically, a stranger claiming to be a legitimate paving contractor knocks on doors in a neighborhood, saying he has asphalt left over from another job. He offers a bargain price to pave or seal the homeowner’s driveway.
When the contractor says the job is finished, however, the bill is thousands of dollars higher than the initial quote. Victims may later discover the paving was poorly done with cheap materials but can no longer reach the contractor.
Similar schemes promote roof replacement, chimney repairs and other home improvement jobs.

Homeowners who need home repairs should look for contractors themselves, instead of hiring someone who shows up uninvited at their door.
Consumers also should:
- Get three written bids.
- Only hire contractors registered with L&I.

The Right Nonprofit Email Frequency:
Data-Driven Tips for Your Strategy

Google rolled out a Gmail unsubscribe feature in July that makes it easier for users to see how many emails they’re receiving from different senders and unsubscribe from them in one place. I couldn’t wait to dive into the new “Manage Subscriptions” section of Gmail and test out the feature. Now my inbox is a lot less cluttered when I wake up in the morning.
That’s great for users, but maybe not so good for brands. As a result, it’s now more important than ever to think carefully about your nonprofit email frequency and overall strategy.
The number of emails nonprofit sent increased by 9% year-over-year, according to the 2025 M+R “Benchmarks” report. This appears to be how organizations are combating the 10% decline in email revenue. I expect email volume to rise again this year as nonprofits look for cost-effective ways to engage supporters and reactivate lapsed donors.
This leads to the question: As email inboxes get more crowded, how do you know if your nonprofit email frequency is too high — or too low?

One change we’re watching closely is the Engrossed Substitute Senate Bill 5814 which added many new activities to the definition of retail sales, including live presentations. These new tax rules are starting on October 1, 2025, despite the fact that there are still many unanswered questions and much confusion among most nonprofits and businesses.
We, at NAWA, have consulted with tax professionals and requested some assistance from the Department of Revenue. (You can request assistance with specific tax questions from the WA Department of Revenue here and request a binding tax ruling here.) Since we are not ourselves tax professionals, we cannot share out guidance for our members and other nonprofits. Please review the initial guidance that was provided by the Department of Revenue, including the results of their Listening Sessions.
What we can share is that we believe ESSB 5814 will require us to charge retail sales tax on live presentations, including our workshops, conferences, and training, whether held in person or online. This also applies to videos of recorded sessions. Our status as a 501 (c)(3) nonprofit does not provide exemption from this new rule.

Plan to Add 151-Home Development

A housing project that could add 151 new homes in Poulsbo off Highway 305, connecting two existing residential neighborhoods, is in the planning stages, according to city documents.
Known as the Pinnacle at Liberty Bay, the preliminary plans filed with the city by Montebanc Managment of Issaquah, a development company, call for a neighborhood of single family homes on approximately 42 acres on currently forested land between the Baywatch Court and Crystal View neighborhoods, which are located just north of Highway 305 before the roundabout at Johnson Parkway. According to the proposal, approximately 840 existing trees will be preserved, which exceeds 25% of the amount currently across an area made up by four separate land parcels. Plans additionally call for several small parks and walking trails within the development, where lot sizes would average 5,000 square feet. Over 36% of the land will be preserved as open space, according to the applicant, and a large retention pond would be built along the project's buffer to the highway.
The west end of the new neighborhood would connect to an existing road at Baywatch Court, which exits onto Highway 305, a new road would connect into the south end of Sunrise Ridge, and another would connect to Johnson Parkway to the east. The initial phase would be the neighborhood connection to Sunrise Ridge Lane, according to the proposal.

Drivers should plan for lane closures beginning Monday, Sept. 8, as the Navy begins seismic upgrades on the Anderson Hill Road railroad bridge near the Old Frontier Road intersection in Silverdale. One lane will be closed Monday through Thursday from 7 a.m. to 4 p.m. Both lanes will reopen Friday through Sunday. The initial construction phase is expected to last 4-6 weeks.

Expect single lane closures on NW Bucklin Hill Rd that will shift throughout the day. Flaggers, signs, and cones will be present. There will be equipment and workers within the roadway. Expect 5-10 minute delays.
