About the Presentation
The Special Needs Planning Toolbox for Estate Planners
Elizabeth Gray and Sarah C. Aviles of McCandlish Lillard, P.C. will discuss the many different planning techniques for a beneficiary with disabilities. This includes an overview of the government benefits to consider, such as Medicaid, SSI, and SSDI, the different types of Special Needs Trusts used in planning (e.g., first party, third party, and pooled), and the use of ABLE Accounts. They will also discuss planning for the care of a special needs beneficiary with guardians and conservators or powers of attorney.

Elizabeth Gray has been practicing law since 1996. She is a member of the bar of the Commonwealth of Virginia. Elizabeth focuses her practice in the areas of special needs planning, elder law, guardianships/conservatorships, and the administration of estates. Elizabeth is a Past-President of VAELA (Virginia Chapter of the National Academy of Elder Law Attorneys).

She is a Certified Elder Law Attorney by the National Elder Law Foundation (NELF), a member of NAELA’s invitation-only Council of Advanced Practitioners; and Elizabeth is a member of the Special Needs Alliance - an invitation-only nationwide attorney organization. Elizabeth has an AV® Preeminent™ ranking by Martindale-Hubbell and a “Superb” rating on AVVO. Sarah has been practicing law in Virginia since 2013. She is a senior associate at the law firm of McCandlish Lillard in Fairfax County, Virginia. Sarah concentrates her practice in the areas of estate planning, special needs planning, trust and estate administration, fiduciary representations, and guardianships and conservatorships. Sarah has represented hundreds of clients through the estate planning process, including business planning, estate tax planning, and special needs planning. Sarah has assisted numerous clients serving as fiduciaries with the administration of estates, trusts, and conservatorships. She has represented many fiduciaries before the Virginia Circuit Courts in matters such as probate-related proceedings, beneficiary disputes, augmented estate claim disputes, and will and trust contests.
Sarah has taught several seminars on Estate Planning, Medicaid, Special Needs Trusts, ABLE Accounts, and Guardianships for various organizations. Sarah received her J.D. from the William & Mary School of Law in May 2013, and her B.A. from the College of William & Mary in May 2009. Sarah was selected as a Super Lawyers® "Rising Star" in 2022 and listed as “Legal Elite” by Virginia Business Magazine in 2021.
