Employment Pitfalls in Construction
Construction companies have some unique issues that make them easy targets for the employment law attorneys looking for representative plaintiffs (your former employees) for class action cases against you. They include these 10:
  1. Tracking meals and rest breaks for on-site employees
  2. Ensuring “net” 10 minute rest breaks
  3. Combining meals and rest breaks
  4. Travel time to and from the job site and the equipment yard
  5. Foremen driving other employees in the company truck; or driving their own vehicles
  6. Carrying tools and equipment and storing in the truck at home
  7. Requiring hand tools and the “double minimum wage” rule
  8. Geo-Fence/GPS and tracking employees
  9. Drug and alcohol testing and monitoring
  10. Piece rate work, bonusing crews and the effect on overtime, sick time and meal/rest penalties
