The “GOLD CARD” Immigrant Visa

On February 25, 2025, President Trump first talked about a plan that would potentially dismantle the EB-5 Immigrant Investor Program and replace it with a new “Gold Card” visa.

Since that earlier announcement, and President Trump’s subsequent commentary during the Joint Address to Congress on March 4, 2025, details regarding criteria for the application process are sparse, though we do have reason to believe that this new program would somehow be interconnected with the existing EB-5 program.

Of course, as we have more details and information, we will certainly send out an update.

For President Trump’s remarks about the proposed program can be found here.

FY2026 H-1B Registration is currently LIVE!

Please know that FY2026 H-1B Registration opened up on Friday, March 7, and runs up until 12:00 noon (ET) on March 24, 2025. Like last year, the beneficiary-centric selection process is still in place, so valid passport or travel document information is required for each beneficiary. The passport or travel document provided must be the one the beneficiary, if or when abroad, intends to use to enter the United States if issued an H-1B visa. New, this year, the registration fee has increased to $215.00 per registration.

NEW Alien Registration Requirement!

On January 20, 2025, President Trump issued Executive Order 14159, Protecting the American People Against Invasion, which directed the Department of Homeland Security to ensure that aliens comply with their duty to register with the government under section 262 of the Immigration and Nationality Act (INA) (8 U.S.C. 1302), and ensure that failure to comply with the registration requirement is treated as a civil and criminal enforcement priority.

Then, on March 12, 2025, DHS announced that it would be publishing an Interim Final Rule (IFR) requiring certain individuals to register their presence and provide their fingerprints if they are in the U.S. for 30 days or more. Meanwhile, an advanced copy of the IFR was published on March 7, 2025 provides us with some key details.

Visa Bulletin - April 2025

Guidance on Expected Visa Availability – The Department of State (DOS) emphasizes: “In the family-based categories, DOS details expected movement in each category for final action and dates for filing. DOS expects dates to hold steady in the coming months on the employment-based side. Specifically, DOS advises, “Readers should never assume that recent trends in final action date movements are guaranteed for the future, or that retrogressions will not be required at some point to maintain number use within the applicable annual limits.”

In April 2025, for EMPLOYMENT-based cases, you must use the  Final Action Dates chart in the Department of State Visa Bulletin for April 2025 AND for FAMILY-based green card categories, you must use the Dates for Filing chart in the Department of State Visa Bulletin for April 2025.
