COVID-19 Update - Reinstatement of Supplemental
Paid Sick Leave

California’s COVID-19 supplemental paid sick leave law (SPSL) was signed by Newsom last week and is now a reality. For employers with more than 25 employees, the law goes into effect 2/19/22 with retroactivity back to 1/1/22. A few important highlights: 

  • For the retroactive obligation, “upon the oral or written request of a Covered Employee,” the employer must provide retroactive payment for eligible leave taken from 1/1/22 to 2/19/22.
 
  • The law provides for a total of 80 hours of paid leave under two separate 40 hour buckets. 
 
  • The first 40 hour bucket is applicable if an employee has symptoms of COVID-19, has to quarantine, etc. and for many of the same other reasons as the first SPSL law.
 
  • The second 40 hour bucket is applicable “if the Covered Employee, or a Family Member for whom the Covered Employee is providing care, tests positive for COVID-19.” Under this second bucket, employers may require proof of the positive test result before paying leave (among other things).
 
  • There is no direct tax credit that reimburses employers specifically for their SPSL costs. Rather, the agreement restores net operating loss deductions for corporate and individual taxpayers with business income of $1 million or more, which had been paused for tax years 2020, 2021 and 2022 and extended by three years.
 
  • An employer may not require employees to first exhaust SPSL when the employee is entitled to Cal/OSHA’s Exclusion Pay requirement under the ETS. If you have questions about Exclusion Pay (which is not straightforward), please contact John Mavros at Fisher Phillips at (949) 851-2424.

The California Department of Public Health (CDPH) recently updated its face covering guidance and announced that it will not be extending its universal indoor face covering requirement set to expire on February 15, 2022.
Back in December, the CDPH issued an order requiring universal indoor face coverings for all individuals, regardless of vaccination status. Then, due to rising cases of the Omicron variant in January, the department extended its order an additional month.

Survey Reports 510 Deals That Total Nearly $10 Billion

By every measure, 2021 was a record year for California hotel deals.
The California Hotel Sales Survey 2021 Year-End reports there were 510 hotel deals for the year, up 71% compared to 2020 and above the 2014 record of 399 deals. The total dollar volume amounted to $9.93 billion, a 204% increase over last year and more than the 2015 record of $9.5 billion. At $265 million, the Montage Healdsburg was the state’s most expensive deal.
