Stopping Speculator Evictions Under Ellis Act

California Assembly member Alex Lee, along with colleagues David Chiu, Richard Bloom and Phil Ting, has introduced AB 854, a key strategy for stopping tenant displacement and the loss of affordable housing.

“The Ellis Act imposes immeasurable cruelty on some of our most vulnerable tenants,” said Lee (D-San Jose). “Especially during a pandemic, we cannot allow for our seniors and working families to be evicted and displaced from communities they’ve been part of for years.”
AB 854 is sponsored by two groups with a long history of tenant advocacy: the Tenderloin Housing Clinic (THC), which I head, and the Coalition of Economic Survival (CES), long led by Larry Gross.

Gross notes that “The Ellis Act has been the number one tool used by developers that has resulted in large scale evictions, displacement and loss of rent controlled affordable housing in the City of Los Angeles.”

The City of Los Angeles, in partnership with the State of California and the federal government, has created the 2021 COVID-19 Emergency Rental Assistance Program (ERAP) to assist residential renters who have been unable to pay their rent as a result of the COVID-19 pandemic. The Los Angeles Housing + Community Investment Department (HCIDLA) is charged with the implementation of the ERAP.

You can complete an online application at hcidla.lacity.org. Applications can also be completed using a smartphone. If a tenant does not have access to a computer, tenants can call the ERAP hotline beginning on March 30, 2021, Monday through Friday from 8:00 a.m. to 8:00 p.m.

A tenant does not need to be behind in rent, but the program priority is to pay an eligible tenant’s past-due rent for the period of April 1, 2020, through March 31, 2021. If funding permits, the program may pay 25% of a tenant’s prospective rent for three (3) months.

The program is open to all renters, regardless of immigration status.

Coalition for Economic Survival Executive Director Larry Gross was interviewed on March 16 on CBS-Los Angeles TV News regarding the new statewide Rent Assistance Program. He said, “I think we're on the tracks of a possible economic train wreck, that there could be mass evictions on the horizon.”
