Important Oklahoma Chamber Blue Update

As you know, The State Chamber launched its association health plan (AHP), Oklahoma Chamber Blue, in October 2018. The plan offers affordable health insurance coverage to our small business members through our partner, Blue Cross and Blue Shield of Oklahoma.

A group of state attorney generals filed a lawsuit in July 2018 arguing the federal rules authorizing the development of AHPs were written to undermine the Affordable Care Act. On March 28, 2019, the U.S. District Court for the District of Columbia struck down the provisions of the U.S. Department of Labor’s (U.S. DOL) final rule that expanded the variety of associations that may offer AHPs. The U.S. DOL final rule on AHPs is what allowed the Oklahoma Chamber Blue Association Health Plan to form.

Due to the district court’s decision and additional feedback from the U.S. DOL, the Oklahoma Chamber Blue AHP is temporarily suspending quoting operations for new enrollment. Groups that are currently enrolled in an Oklahoma Chamber Blue plan will not be impacted. Unfortunately, Oklahoma Chamber Blue is unable to enroll new groups at this time. We are still preparing to offer our AHP and a variety of medical, dental, and vision plans for 2020 in anticipation that the U.S. DOL will take quick action and request a stay of the district court’s ruling.
