RETAINAGE MISTAKES THAT THE TENNESSEE CONSTRUCTION INDUSTRY STILL CONTINUE TO (and over and over and over) MAKE
By: David K. Taylor
Bradley Arant Boult Cummings
The most ignored set of laws in Tennessee which impact owners, prime contractors and subcontractors are the construction “retainage” laws which are unique in the United States. Serious mistakes are still being made, and failure to know what the law requires can go right to the bottom line. While the lawyers may love the new cases and legal fees that retainage mistakes can generate, it does not do any good for the companies involved. The purpose of this article is to provide a summary primer of the law and what mistakes are being made.

Last Chance to Purchase Tickets: 1st Annual Hardhats with Heart event with the American Heart Association!
What is Hard Hats with Heart?
Nashville area construction companies joining together with our community’s corporate partners for a networking event in support of the life-saving mission of the American Heart Association.

All attendees will enjoy a special evening that includes:

  • Networking with industry leaders and healthcare professionals
  • Discover the increased risk of cardiovascular disease in the construction industry
  • The opportunity to hear from a local cardiovascular disease survivor
  • Light appetizers and beverages throughout the evening

Why Hard Hats with Heart? Life is Why.
Heart disease is still the number 1 killer of Americans and stroke is number 5. For those in the construction industry, the risk of developing cardiovascular disease is greater than the national average. We know that our most challenging work lies ahead of us and that we are the organization that can meet the challenge. By bringing together professionals from the construction, healthcare, and greater business communities, we can continue our work of funding groundbreaking research, developing guidelines to improve patient care, and help educate our community on how to lower their risk factors for heart disease and stroke.
