House Passes PRO Act

On Tuesday evening, the House of Representatives passed the Protecting the Right to Organize or PRO Act by a final vote of 225-206. 5 Republicans voted for the bill; 1 Democrat voted against. The bill would significantly harm the franchise sector through codification of California's disastrous ABC test from AB5, alongside an expanded joint employer standard, effectively reclassifying franchisees as employees of their brand companies.

IFA and other business groups strongly opposed the bill. Prior to the vote, IFA President and CEO Robert Cresanti penned an op-ed in The Hill outlining the damage the bill could cause including dragging down the country's economic recovery from the coronavirus pandemic. Speaking after the vote, IFA's Matt Haller, SVP for Government Relations and Public Affairs, released the following statement:

“Franchise small businesses are poised to lead our country’s economic recovery and are particularly well-suited to ensuring that hard-hit minority communities have access to the opportunity and equity they need to build back better. Unfortunately, the PRO Act jeopardizes that...

“Put simply, this legislation could end the franchise business model. While the House vote today was disappointing, it was also expected. IFA hopes that the Senate will reject this overly-broad, overly-harmful approach and instead work constructively to improve worker outcomes and economic opportunity.”

The bill now heads to the Senate for consideration. IFA urges all members to take action and join the association's grassroots campaign urging opposition to the PRO Act. If you haven't done so already, please click here or on the button below to send a pre-filled email to your Senators.
