The following information is being provided pursuant to the requirements of Executive Order 2011-01K and Senate Bill 2 of the 129th General Assembly, which require state agencies, including the Ohio Board of Pharmacy, to draft rules in collaboration with stakeholders, assess, and justify an adverse impact on the business community (as defined by S.B. 2), and provide an opportunity for the affected public to provide input on the following rules.

4729:5-15-01 - Animal shelters, dog wardens, and wild animal rehabilitation facilities - definitions. Definition section for animal shelter rule chapter. Amended to add the definition for "wild animal rehabilitation facility" (WARF) and update the definition of positive identification to mirror existing Board rules. Small grammar changes were made to this rule.

4729:5-15-02 - 4729:5-15-02 – Security and control of dangerous drugs. Provides the requirements of the responsible person on the license which includes establishing standards for security, control, and storage of dangerous drugs. Amended to include county dog wardens and WARFs in the rule text.

4729:5-15-03 - Record keeping. Provides the requirements for record keeping at an animal shelter. Amended to include county dog wardens and WARFs in the rule text. Removed expiration date from the required information for a record of transfer or sale. Small grammar changes were made to this rule.

4729:5-15-04 - Drugs approved for euthanasia. Specifies the drugs that are approved for euthanasia. Amended to include employees of WARFs in the rule text as an entity not allowed to perform euthanasia by lethal injection.

4729:5-15-05 - Chemical capture classification. Establishes the process for an animal shelter or county dog warden to apply for a chemical capture classification to their limited license. Also authorizes the drugs that can be administered as part of chemical capture. Amended to note a WARF is not eligible for a TDDD license with a chemical capture classification. Small grammar changes were made to this rule.
