CalRecycle released four documents today as part of the SB 54 implementation process, including the:
SB 54: Release of Draft Regulations
CalRecycle released the draft regulatory text for the implementation of SB 54 (Allen, Chapter 75, Statutes of 2022). A 45-day comment period will open next year when CalRecycle initiates the formal rulemaking process. The same draft regulations will be submitted to the Office of Administrative Law (OAL) to initiate the formal rulemaking process.
CalRecycle will host a question and answer session in early 2024. During this session, CalRecycle will present the complete draft regulatory text to the public and offer clarification as necessary. CalRecycle staff will cover specific articles of the regulations. The CRA team will provide our members with details of the session including date, time and agenda, as soon CalRecycle releases them.
SB 54: Publication of Covered Material Categories List
Pursuant to Section 42061(b) through (c) of the Public Resources Code, the following documents have been published on the new SB 54 Covered Material Categories webpage:
Covered Material Categories List, including:
a. SB 54 Covered Material Categories
b. Evaluations of potential recyclability and compostability for each CMC
Covered Material Categories Supplementary Material, including:
a. Part I, which contains relevant background information on CMCs
b. Part II, which includes the updated list of CMCs and changes made to the draft list of CMCs presented at the September 27, 2023 public workshop
SB 54: Report to Legislature
Pursuant to Section 42061(a)(3)(B) of the Public Resources Code (PRC), CalRecycle released the Report to Legislature on the status of material types relative to the requirements of PRC 42355.51(d)(2)(A) through (B). The report provides information related to recyclability of single-use packaging and single-use plastic food service ware in California.

SB 54 Advisory Board - First Meeting Announced
With today's release of these four SB 54 documents, including the draft regulatory text, CalRecycle also notified the SB 54 Advisory Board that CalRecycle will be scheduling the first advisory board meeting in early February to give board members time to review the materials and prepare for the first meeting.
As a reminder, CRA President and CEO Rachel Michelin was named to the inaugural Plastic Pollution Prevention and Packaging Producer Responsibility (SB 54) Advisory Board and will be serving as an important voice for the retail industry and larger business community during the SB 54 rulemaking process. Circular Action Alliance Updates (SB 54 PRO applicant)
CRA is closely monitoring next steps in the implementation of SB 54 and how our members will need to comply. Critical to SB 54 compliance is the selection of the PRO, which will administer SB 54 and manage many producer compliance obligations on their behalf.
