In the past year, parents who share joint legal custody of their children have faced some of the hardest decisions they have ever made. They have had to decide if they are comfortable sending their kids to school or moving them to home school. They have had to decide whether to send their children to their best friend’s birthday party where a large numbers of guests may be present. Some parents are starting to argue over the COVID-19 vaccine – even if their child isn’t eligible for the vaccine based on age.
Many lawyers and the public believe that when they have a dispute regarding a joint legal custody decision, the court’s own personal beliefs will guide the court's decision-making regarding whether a child will receive a vaccination. Is that true? Is the court supposed to apply its own beliefs on vaccinations, or is the court to be choosing between the parents and deciding who has the best interest of the children at heart?
In this CLE, Judge Bridget Robb and Judge Nathan Tod Young will discuss the standard and explain how they come to decisions in joint legal custody disputes.
