Nevada Supreme Court Amends Civil Justice Court Rules

The Nevada Supreme Court issued an order on August 30 regarding ADKT 0607, which repeals and replaces the Nevada Justice Court Rules of Civil Procedure (JCRCP) to read as set forth in Exhibit A, effective 60 days from the date of this order.

 

On January 24, 2023, Ann Zimmerman, Justice of the Peace in the Las Vegas Township Justice Court, on behalf of the Nevada Judges of Limited Jurisdiction (NJLJ), filed a petition in the Supreme Court seeking to amend the JCRCP. On May 12, 2023, the court issued an order repealing and replacing the JCRCP with an effective date of July 12, 2023.

 

Subsequently, the NJLJ filed a motion to extend the effective date for 90 days. On October 10, 2023, the NJLJ requested a stay of the effective date of the previously approved amendments and filed a petition seeking amendments to the JCRCP in addition to those approved in the court’s May 12, 2023, order.

This Week at the State Bar

The State Bar of Nevada is looking for qualified individuals (attorneys and non-attorneys) from both the south and north to fill open positions on the Fee Dispute Arbitration Committee. The application deadline is Friday, September 20.

Mendoza, Talim Take Oath as Eighth Judicial Court Judges

Judges Erika Mendoza and Tina Talim were ceremonially sworn in at an investiture on September 5 at the Clark County Government Center Commission Chambers at 500 S. Grand Central Parkway.

 

Mendoza is serving as a judge in Department 27 of the Eighth Judicial District Court. Prior to her appointment, she served in the Clark County District Attorney’s Office. She is married to a native Las Vegan and local business owner, and they have two sons.

 

Talim, Nevada’s first Indian American judge, is the presiding judge in Department 14. She started her career in civil litigation then served nearly two decades as a prosecutor with the Clark County District Attorney's Office. Talim was promoted to the High Intensity Drug Trafficking Area Unit, where she prosecuted international drug cartels.

Applications Available for Vacancy in First Judicial District

Governor Joe Lombardo announced the retirement of the Honorable James T. Russell from the First Judicial District Court of Nevada, Department 1. Russell will retire at the end of October 2024.


The Commission on Judicial Selection will convene to fill the forthcoming vacancy left by Russell’s retirement. Applications are due by noon on Thursday, September 19.

Legal Aid Center Hosting CLE Series on Federal Court

The Legal Aid Center of Southern Nevada (LASCN) is hosting Demystifying Federal Court,” from 11:30 a.m. until 1 p.m. on Tuesday, September 10, in the Engelstad Family Classroom and via GoTo Meeting.

 

This CLE is part one of a series on representing clients in federal court. Speakers will include U.S. Magistrate Judge Daniel Albregts, U.S. Magistrate Judge Elayna Youchah, and attorney David Chavez of Ballard Spahr. Also in attendance will be Chief U.S District Judge Miranda Du, District Court Judge Anne Traum, and Magistrate Judge Brenda Weksler.

Court of Appeals, Federal Bar, State Bar Hosting CLE in October

The U.S. Court of Appeals for the Ninth Circuit, the Nevada Chapter of the Federal Bar Association, and the State Bar of Nevada are sponsoring a free CLE titled “The Art of Appellate Advocacy: A View from the Ninth Circuit Bench,” from 2-4 p.m. on Tuesday, October 8, in the jury assembly room at the Lloyd D. George U.S. Courthouse in Las Vegas. There will also be a Zoom option.


Ninth Circuit judges who will be sitting in October, and Susan V. Gelmis, chief deputy clerk for operations, will present on effective brief writing and oral argument, give an insider’s guide to Ninth Circuit Practice, and update attendees on recent policy changes.

 

A reception will immediately follow the program.

First Judicial District Bar Association Hosting CLE Lunch Friday

The First Judicial District Bar Association (FJDBA) is hosting a one-hour general credit CLE titled “Felony Specialty Courts in the First Judicial District” at noon on Friday, September 6, at Red’s Old 395 Grill at 1055 South Carson Street in Carson City.


Deborah Schumacher will be the speaker.
