SBTC Investigation into New UCR Online Payment Platform Reveals Numerous Technical Deficiencies Blocking Carriers' UCR Payments
Summary: On February 21, 2019, SBTC President James Lamb released SBTC's findings that the UCR Payment platform is corrupt and is not properly pulling data from USDOT systems in reference to carriers' last four of tax id numbers being used as passwords to make UCR payment, causing an estimated tens of thousands of carriers not to be able to file their UCR. SBTC also points to archaic manual and electronic data collection methods by USDOT that have resulted in data being "transposed." SBTC suggests security professional industry protocol requires a two step verification process when passwords are set. Echoing its call for UCR Board members to be removed and replaced due to more than a decade of Sunshine Act violations, SBTC has called on Secretary Chao to step in and direct the removal of the last four tax ID number requirement that is blocking carrier payments before the April 1st enforcement date. SBTC also suggests a class action suit may follow if carriers are ticketed after having made good faith efforts to file their UCR but were blocked by the payment system. SBTC's email on which the Secretary of Transportation was copied follows...

Subject: RE: Request for Meeting Re: UCR Board Policy Obstructing Motor Carrier Registration

Did FMCSA meet with you, Laurence, or are they ignoring this issue?

The chat pasted below with the UCR Help Desk shows the UCR Board knows --or should know --of an issue regarding the last 4 digits of carriers' tax ID numbers not properly being transmitted from USDOT to SeikoSoft, yet the UCR Board has done absolutely nothing to relieve carriers from this filing obstacle over the nearly 2 months.

The UCR Board itself has not been forthcoming in telling us about the nature of this problem or its solution. We had to investigate and figure it out on our own. The SeikoSoft system is apparently not receiving all digits needed from the USDOT system. Carriers are being told they have to guess what the tax ID number on file is because certain digits in the data are either missing or digits are being "transposed" presumably due to the original collection method which did not include a tow step verification process that is industry standard. The UCR Help desk is referring carriers to FMCSA for help.

Blocking carriers from paying fees in furtherance of a Congressionally charted interstate agreement that are used by the 41 participating states for motor carrier safety enforcement is clearly not in the public interest.

We are coming up on the enforcement date at which time tens of thousands of carriers( if not more) who tried to file their UCR in good faith will begin to get ticketed.

FMCSA is knowingly enabling this problem by not intervening.

As UCR is the act of registering interstate operations with the states, the Federal government has the power to preempt the states' interference with interstate commerce by directing the UCR Board comprised of state representatives to remove this obstacle to registering. I know the UCR Chair copied here is telling you the tax id problem is mostly with Canadian carriers but that is not accurate. That issue is an additional, separate problem because Canadians do not have an American tax ID at all.

This migration from Indiana to SeikoSoft copied here is a complete and utter disaster and the UCR Help desk admits it below. Something has to be done. The Secretary of Transportation is therefore copied here in furtherance of our call to remove and replace existing UCR Board members.

The obvious solution is to just turn the tax id requirement OFF until and unless the system works. The UCR Board did without this feature for 12 years. It can do without it from now until they fix it.

Please share this email with Congressional oversight staffers so that carriers can get relief before states like Colorado begin fining drivers $1,100. In some cases, state law calls for fines per day. As carriers' property interests and due process rights are involved here, this is headed for a class action suit if this does not get immediately resolved and mass enforcement begins. The Bopp Law firm is therefore copied here.

Kevin
No, I know that one is correct.

Kate
Sorry, I do not have access to that number

Kate
I'm sorry you're having trouble accessing your account. Your Tax ID can be either an FEIN or a Social Security number.  If you're not able to get any of those numbers to work, please contact the FMCSA to retrieve it.  There are times when there is a number they have on file with a transposed set of digits or sometimes a digit is dropped off the end. I'll include a couple of phone numbers to try, as well as a contact link for you here.

10:03:23 Kevin Hello, I am attempting to file the 2019 UCR and it is telling me the last 4 of the tax ID I am entering is wrong. I know this is not the case. How can I fix this?
10:03:23 Kevin I just had this chat, and my associate called in and was told that there is an issue with the last 4 of the tax ID having a zero in it.
10:03:40 Kevin Is this what the lady above meant by "transposed"?10:03:53 Lori Transposed means that 2 numbers are interchanged. For instance 12 would become 21.
10:04:27 Lori If you can let me know your Tax Id I can check to see if there is something like that going on.
10:04:46 Kevin I only have the last 4, 3340
10:04:57 Kevin And when my associate called, a lady on the phone said it was an issue with the zero, and to use the next digit before the zero.
10:05:27 Lori YOu would need the whole tax ID to get that information.
10:05:37 Lori Drop the zero and use the last 4 as though the zero isn't there
10:05:56 Kevin I see. And if I discover the zero is the next number, what would I do in that case?
10:06:59 Lori I your specific situation the "0" was dropped off the end in the FMCSA records.  It doesn't have any thing to do with it being a zero. It just happened to be a zero. Once you find your whole tax Id you will be able to register.  If you need help finding the Tax ID I can give you a contact link to the FMCSA
10:08:35 Kevin So it will only drop off the last digit? I ask because I want to make sure another number besides the "0" did not drop off and I am still entering a bad number.
10:09:35 Kevin For example, how would I know if it is the "4" that should be dropped rather than the "zero"?
10:09:54 Lori I looked a tit and saw that the 0 is missing in the records.
10:10:36 Lori *at it
10:10:44 Kevin I see.
10:12:08 Lori Once you retrieve that Tax ID you will be able to register using the last 4 numbers if you ignore the 0 on the end
10:12:58 Kevin Okay
10:13:10 Lori Is that making sense now?
10:14:21 Kevin Yea, thanks'
10:14:40 Lori You're welcome!
10:14:46 Lori Have a great day!

Subject: Request for Meeting Re: UCR Board Policy Obstructing Motor Carrier Registration

Dear Administrator Martinez -- I am writing to you on behalf of the Small Business in Transportation Coalition (SBTC) to request an immediate meeting with you personally or appropriate FMCSA staff regarding what SBTC believes is a serious issue relating to obstruction by the Unified Carrier Registration Plan Board of Directors in implementing a new platform on the UCR.gov domain that requires motor carriers to enter the last four digits of their tax id number to comply with the annual UCR filing requirement.

SBTC is learning from thousands of its members that the the new system is blocking or rejecting their tax id number and, because of other glitches in the system, they are not able to successfully comply with the UCR filing requirement.

SBTC President James Lamb sent you (copying Larry Minor and Charles Fromm) an email earlier today with far more detail regarding this issue. I will not repeat it here; but I refer you to Mr. Lamb's earlier email.

It is vital that I meet with you, or appropriate staff, immediately as this issue is affecting thousands of SBTC's 15,000 members.

Please let me know the earliest date and time you can meet with me.

Thank you for your attention to this urgent matter.

Very truly yours,

Laurence L. Socci
