Dear Dana Point Boaters,
We hope you are enjoying the Holiday season. Boaters are busy people. While decorating, planning get-togethers, and shopping is the focus for many of us this time of year, the Class Action proceedings over the massive increase in slip fees in Dana Point Marina proceeds. Scheduled for this month is a deposition of DPHP’s custodian of records. Also, the Class attorneys will be filing a Motion to Certify the Class, which, when granted, will kick the case in high gear toward a trial or settlement.
The slip fees charged by DPHP are by far the highest of any public marina in the area. The Class Action lawsuit contends these slip fees violate the DPHP’s written agreement to maintain “market” rates. The Partners are doing everything they can to slow down the process and multiply the costs and fees of the proceeding in hopes that “donor fatigue” will cause the action to be abandoned. However, boat owners are vigilant and determined to carry on until the conclusion is reached. Other interested parties are likewise invested and willing to do whatever it takes to make certain the outcome of the case gets decided on the merits.
