Regulatory and Policy Information Related to Chemical Safety & Security

EPA Adds Nine PFAS to the Toxics Release Inventory

EPA announced the automatic addition of nine per- and polyfluoroalkyl substances (PFAS) to the list of chemicals covered by the Toxics Release Inventory (TRI) on January 3, 2025. These nine PFAS were added to the TRI list pursuant to the Fiscal Year 2020 National Defense Authorization Act (NDAA), which provides the framework for the automatic addition of PFAS to TRI each year in response to specified EPA activities involving such PFAS. For TRI Reporting Year 2025 (reporting forms due by July 1, 2026), reporting is required for these nine additional PFAS, bringing the total PFAS subject to TRI reporting to 205.


EPA Proposes Rule to Clarify Supplier Notification Requirements for TRI-Listed PFAS

On January 16, 2025, EPA announced a proposed rule to clarify the timeframe for when companies must first notify a customer that one of their mixtures or trade name products contains a PFAS listed on the TRI, in accordance with Section 7321(c) of the Fiscal Year 2020 NDAA. This law provides the framework for the automatic addition of PFAS to the TRI each year on Jan. 1 in response to specified EPA activities involving PFAS in the preceding year. EPA is taking this action in response to questions from industry regarding the effective date of supplier notifications for PFAS added to TRI pursuant to the NDAA. Please see the Addition of Certain PFAS to the TRI by the National Defense Authorization Act web page to learn more. USDOT NPRM: Advancing Safety of Highway, Rail, and Vessel Transportation

The U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration's (PHMSA's) Notice of Proposed Rulemaking (NPRM) titled “Hazardous Materials: Advancing Safety of Highway, Rail, and Vessel Transportation” was published to the Federal Register on October 28, 2024. This NPRM proposes amendments to improve the safety and efficiency of hazardous materials transported by highway, rail, and vessel, as well as several amendments for all modes of transportation. The comment period has been extended, with all comments due by April 28, 2025. Comments may be submitted here.


USDOT Proposes New Rule to Strengthen Safety Requirements for Carbon Dioxide Pipelines

On January 15, 2025, the U.S. Department of Transportation's PHMSA announced new comprehensive proposed requirements for carbon dioxide (CO2) and hazardous liquid pipelines. The full text of the NPRM will be available in the Federal Register on publication. Those interested in commenting on the NPRM must do so within 60 days of publication in the Federal Register by submitting comments here.

U.S. Chemical Safety Board Releases New Safety Video on 2020 Fire and Toxic Gas Release at Bio-Lab Facility in Westlake, Louisiana

The U.S. Chemical Safety and Hazard Investigation Board (CSB) released a new safety video on its investigation into the August 2020 fire and toxic gas release at the Bio-Lab Lake Charles chemical facility in Westlake, Louisiana, that occurred when the facility was severely damaged by Hurricane Laura.


U.S. Chemical Safety Board Announces New Safety Product to Provide the Public with More Information about Serious Chemical Incidents Reported to the Agency  

The U.S. CSB announced that it is launching a new initiative to give the public more details about the serious chemical incidents that have been reported to the CSB since the agency’s Accidental Release Reporting Rule (ARRR) went into effect in March 2020. The CSB will be compiling summaries of reported incidents and making them available to the public on the CSB’s website on a regular basis. The CSB released Volume One of the Incident Reports on January 14, 2025.

Safety Advisory: Possible Catastrophic Failure of Nurse Tanks and Recommendation for Periodic Testing

The Federal Motor Carrier Safety Administration (FMCSA) and the PHMSA have issued a safety advisory to provide notice of the possibility of catastrophic failure of certain hazardous materials packages commonly known as “nurse tanks.”


USDOT PHMSA Letters of Interpretation: Lithium Batteries

The U.S. Department of Transportation’s PHMSA has recently issued several Letters of Interpretation (LOIs) in response to several inquiries related to the transportation of lithium batteries. The LOIs are focused on:

  • 24-0034 – “DDR battery determination of HMR applicability”
  • 24-0041 – “Lithium Batteries State of Charge”
  • 24-0064 – “Foam Battery Trays”
  • 24-0085 – “Shipper’s Agent for Shipping Lithium Batteries.”

FEMA Radiological Emergency Preparedness Program Lunch and Learn Webinar Series, Various Topics and Dates, Virtual

FEMA will host a series of new weekly Lunch and Learn webinars every Thursday, beginning February 20 and concluding on March 6, 2025. These sessions will focus on FEMA's updated Radiological Emergency Preparedness Program Manual, which provides planning and assessment guidance for state, local, Tribal Nations and territorial partners located near commercial nuclear power plants. Ammonia Safety & Training Institute (ASTI) presents Safety Day training and chemical Tabletop Exercises (TTX) available to local industry and community responders

  • ASTI formed the National Safety Day Coalition together with IIAR, RETA, and GCCA to present safety and emergency response preparedness training at minimal cost to the attendees.
  • ASTI worked with Region 9 EPA to create ammonia Tabletop Exercises based upon the One Plan four stages of response; focused on engaging local, state, and federal emergency response plans.
  • ASTI organizes and leads a local committee of industry, public safety, and governmental leaders to create Safety Day presentations and Tabletop Exercises.
  • Sample topics include: hazard analysis, health & safety concerns, critical task readiness, e.g., emergency system control, rapid “grab and go” rescue by first responders, and methods of containment and control of ammonia events using proper methods e.g., personnel protective equipment, decontamination, teaming agreement with public safety responders, monitoring systems, and command team coordination and communications readiness to address on-site and off-site life safety and environmental receptors.
