The American Board of Trial Advocates (ABOTA) is an invitation-only organization of over 7,600 of the nation’s premier plaintiff and defense trial attorneys. The Masters in Trial presenters are members of ABOTA, trial experts and experienced trial judges.

PROGRAM

Watch some of our premier trial attorneys demonstrate how to try a case with time limits in front of a live jury including jury deliberations, all in one day!

CASE

This lawsuit was brought on behalf of Plaintiff Eric Patrick against ACA Pacific Materials who owned, controlled and operated a rock crushing plant.

Plaintiff, a salesman for Blake Rubber Co., was inspecting a rubber conveyor belt next to an ACA elevated walkway. The walkway failed and Plaintiff fell

18 feet to the ground below and suffered a serious back injury requiring a five level back fusion.

Plaintiff is seeking compensatory and punitive damages against ACA for failing to maintain the walkway.

Defendant ACA denies liability, alleging that (1) it inspected and maintained its premises in a reasonable manner (2) that there was no reason for Plaintiff to ascend the walkway as the inspection could have been done from ground level and (3) that there was no willful and conscious disregard for safety as all of the ACA personnel used the elevated walkway every day.
