Supreme Court to Hear Case
on Criminalization of Homelessness
|
On April 22nd 2024, the Supreme Court of the United States will hear the case of
Johnson v. Grants Pass. This sets the stage for the most significant Supreme Court case about the rights of homeless people in decades. At its core, this case will decide whether cities are allowed to punish people for things like sleeping outside with a pillow or blanket, even when there are no safe shelter options.
Johnson v. Grants Pass is a court case originally filed in 2018 that determined it is cruel and unusual punishment to arrest or ticket people for sleeping outside when they have no other safe place to go. The case started in Grants Pass, Oregon when the city began issuing tickets to people sleeping in public, even when there were not enough safe, accessible shelter beds.
Grants Pass, like many cities in America, is thousands of housing units short of what is needed. That shortfall will not be solved by putting more people in jail or issuing more tickets. The solution to homelessness is safe, decent, and affordable housing for everybody.

HUD Releases New Area Median Income Calculations
and Rate Cap for Rents in LIHTC Properties
HUD recently made changes to its calculation for area median income (AMI), which determines maximum allowable rents on certain affordable housing units that are subsidized by the federal government. The calculation would limit the amount rents could be raised in Low-Income Housing Tax Credit (Housing Credit) properties to no more than 10%. An article from The Washington Post notes that the new calculation will likely have limited impact for Housing Credit properties because developers in the program are committed to certain affordability rules that limit their ability to increase rent by 10% in one year. The announcement from HUD is part of the Administration’s Blueprint for a Renters Bill of Rights, a document outlining the White House’s commitment to tenant protections.

SHA-NJ Seeks Participation In Westfield
Integrated Community Project Listening Sessions
| |
|
The Westfield Integrated Community Project (ICP) is recruiting people who live or work in Westfield to participate in virtual listening sessions. The two listening sessions in April are an opportunity for the ICP to hear about how the Town of Westfield already involves people with disabilities and barriers in daily life in the community, what is missing in your life in the town, and how the town can do a better job in giving you connections to different parts of daily life. The goal of the ICP is to increase the capacity of people with disabilities or barriers to become completely engaged in their communities.
For more information, please reach out to Kate Kelly, Associate Executive Director, Supportive Housing Association NJ. This flyer advertising the listening sessions and a one pager offer more details about the listening sessions and the Westfield ICP project. Individuals with disabilities and barriers who are interested in joining a listening session can use this link to share their interest - https://forms.gle/wD5PV7ZdPXhVpmzE6. DDD Update:
DHS OPIA Bulletin Resume
Normal Employee On-Boarding
| |
|
With an increased availability of fingerprinting appointments, the Department of Human Services’ (DHS) Office of Program Integrity and Accountability (OPIA) will be returning to normal onboarding requirements for direct support professionals and self-directed employees effective April 15, 2024. OPIA will continue the temporary clearance process until then.
Effective April 15, 2024, new hires must complete onboarding requirements prior to employment, and OPIA’s Employment Controls and Compliance Unit (ECCU) will no longer process emergency requests for hire. For employees who have already begun employment based on emergency approval prior to April 15, 2024, employers have until June 15, 2024 to complete criminal background checks via fingerprinting.
Please review the April 1 DHS Information Bulletin, Updated Employee Onboarding Requirements.

Social Security to Raise the
Representative Fee Cap to Help with Claiming Benefits
| |
|
The Social Security Administration (SSA) plans to raise the fee cap for claimants’ representatives, from $7,200 to $9,200, when they and their client agree to use what is known as a “fee agreement process.” This will be the first increase to the fee agreement cap since November 2022, when the cap went up from $6,000 to $7,200, after remaining the same for thirteen years.
The fee cap increase is scheduled to take effect this Fall. The agency also plans to tie future increases to the annual cost-of-living adjustment (COLA). SSA will publish notice of this change in the Federal Register in April in advance of the effective date.
Fees are paid from beneficiaries’ past-due benefits. When a claimant or beneficiary decides to retain representation, the representative is required to obtain approval of any fee from SSA. The fee agreement cap is the maximum dollar amount an appointed representative can receive under the “fee agreement process” for successfully representing a person in a case for disability benefits. The cap does not apply to the “fee petition process.”
Due to underfunding, SSA is currently experiencing growing disability backlogs in the State Disability Determination Services that make initial and reconsideration decisions for the agency. Disability applicants are waiting on average nearly 8 months (228 days) for an initial decision and an additional 7 months (223 days) for those who request a reconsideration appeal. SSA’s long-term goal is to reduce those waits to 4 months (120 days) each. Representatives can help SSA develop medical evidence in disability claims more fully, which allows SSA to issue decisions more efficiently. Information about appointed representatives is available at www.ssa.gov/representation. Once retained, a representative must file a fee agreement form, SSA-1693.

|
The Federal Home Loan Bank of New York (FHLBNY) is pleased to announce that the 2024 Affordable Housing Program (AHP) General Fund Round will open on Monday, April 22, 2024, with approximately $70,819,534 in available housing grant funds. These funds are awarded through an annual competitive process, with the final award announcements being made in late fall.
In preparation for this year’s round, please review the 2024 AHP Implementation Plan which is available on our website and introduces the following changes to the scoring framework:
- Increased maximum AHP General Fund subsidy to $2,000,000 from $1,500,000 per project and increased subsidy per unit to $60,000 from $40,000;
- In the Creating Economic Opportunity scoring category, the scoring criteria were simplified; and
- For the Project Readiness scoring category, documentation requirements have been streamlined to allow for the new AHP General Fund Project Readiness – Approvals Certification form.
We strongly encourage you to review the recordings of the initial 2024 AHP General Fund Trainings (which were held on February 14, 2024 and February 22, 2024) and attend the upcoming AHP General Fund Training Session (to be held on March 26, 2024). NJ State Rehabilitation Council
Public Forums Listening Sessions
| |
|
April 30th | May 1st | May 6th
The State Rehabilitation Council (SRC) supports, advises, and collaboratively problem-solves with its partner, The New Jersey Division of Vocational Rehabilitation Services (DVRS). The SRC and DVRS are seeking the public’s input about topical issues impacting consumers, vendor communication, and dialogue with employers.
Your voice is extremely important to both the SRC and DVRS and will help to shape program delivery and policy to ensure that people with disabilities receive rehabilitation services that result in employment.
We are particularly interested in hearing from people with disabilities, family members of people with disabilities, educators, and others about their lived experience with transition planning and/or services. We want to learn about the issues, concerns, strengths, and suggestions you may have about transition from school to work in our state generally, and as it pertains to DVRS specifically.
Representatives from the SRC and DVRS will be available to hear public comments and testimony and take all information received under advisement. The information will be used by the SRC to help craft its ongoing efforts with DVRS to ensure New Jersey has a rehabilitation program that is comprehensive, consumer responsive, and effective.
Registration closes April 23, 2024.
