Supervisors Approve New SLO County Ag Pass Program

County Supervisors gave the green light for a new SLO County Ag Pass Program last week. The program allows agricultural producers to undergo training and potentially be allowed access to their farms and ranches during a wildfire or other natural disaster. 


SLO County developed a local Ag Pass program in 2021, but the state legislature created new standards for county ag pass programs with passage of AB-1103 later that year. In coming months, the SLO County Agriculture Commissioner’s office will be announcing training dates and application details for the new Ag Pass Program. 


SLO County Fire Department has developed an approximately 4-hour curriculum that will provide a primer on basic fire behavior, communications during disaster, and incident command structure (ICS). Ag Pass authorization cards will be valid for two years. Additionally, shorter, “refresher” training will be made available online at Ag Pass card renewal time. 


Who is eligible for an Ag Pass? 

For the initial program rollout, no more than three (3) individuals from any agricultural operation (not each individual site of the operation) will be eligible to obtain an Ag Pass. The purpose of the Ag Pass is to potentially allow an agriculturalist access to his or her farm or ranch for limited emergency response activities to protect or care for agricultural assets only. It is not a pathway that allows for normal agricultural operations or activities (i.e. harvesting, packing, planting, etc.).


The Ag Pass will only be available to agriculturalists who meet the following criteria:

  1. Property must be located in the State Responsibility Areas (SRA) of San Luis Obispo County (see the map here.) Because properties in the Wildland Urban Interface are subject to rapid change during wildfires or similar disasters, Ag Passes are only appropriate in the SRA.
  2. The operation must be: a. A commercial agricultural enterprise; or b. Property used for conducting agricultural research or instruction by an educational institution.
  3. Property must be zoned agricultural and a minimum of 40-acres in size.
  4. The Applicant is key personnel of the operation that has a working knowledge of the agricultural property, including access to irrigation systems, farm equipment, and other essential infrastructure.
  5. The Applicant and employer (if different than the Applicant) must sign a waiver and release.


An Ag Pass eligibility committee (“Committee”) organized by the Agricultural Commissioner’s Office will be responsible for confirming eligibility based on the above criteria. The Committee will be composed of representatives from the Agricultural Commissioner’s Office, County Fire, Sherriff’s Office, Cattlemen’s

Association, Farm Bureau, Fire Safe Council and UC Cooperative Extension.

Executive Director Report

Here are a few things we worked on this week:

  • Met with Supervisor Debbie Arnold;
  • Participated in the SLO County Agricultural Liaison Advisory Board April 3rd meeting which included discussion on developing an “Accepted Customs & Standards” document for wind machines in response to noise complaints;
  • Participated in the SLO Food System Coalition Steering Committee meeting;
  • Monitored the April 4 Board of Supervisors meeting; 
  • Wrote a column about local agriculture issues for the Central Coast Journal (to be published in May); 
  • Submitted a letter to the State Fire Marshall’s office regarding the proposed changes to the Fire Hazard Severity Zones;
  • Board Member Steve Carter represented Farm Bureau on the SLO County Water Resources Advisory Committee meeting; and
  • Gave our weekly update on 98.1 KJUG’s Tom & Becky Show (Thursdays around 9:10am).

California Farm Bureau continues to engage on the rulemaking process for Advanced Clean Fleets, a regulation that targets the electrification of large diesel fleets in California. At the end of March, the California Air Resources Board provided mostly technical amendments to the previously drafted regulation. Section D of the released draft has added problematic language moving the deadline of 100 percent ZEV sales from 2040 to 2036. Farm Bureau continues to express concerns with ZEV availability, charging infrastructure in rural communities, and the costs associated with upgrading fleets. This item will be heard in front of the Board on April 27.

On March 28, the Assembly Budget Subcommittee spent a rainy afternoon well into an evening featuring a brief respite from our recent rains considering “budget change proposals,” submitted by state agencies to the Governor’s 2023/2024 budget. These “BCPs” generally involve requests to reprogram spending or increase spending to implement changes in the law passed by the Legislature in the prior legislative session. On March 28, the committee considered a different sort of BCP.

Indoor Heat Regulation Released

Late last week, the Cal/OSHA Standards Board published the official version of the new indoor heat illness prevention standard. The proposal has entered its 45-day comment period.

 

The regulation will apply to indoor workplaces where the temperature is at least 82°F. Employers subject to the standard will be required to establish, implement and maintain an effective heat illness prevention plan, including the provision of water, shade, acclimation for newly assigned employees, emergency response procedures, and control measures to minimize the risk of heat illness. Indoor work areas with temperatures of at least 87°F have additional requirements. Click here to learn more.
