Food & Agriculture Industry Now Eligible for Vaccines in San Luis Obispo County

Pictured above, SLO County Farm Bureau member Greenheart Farms of Arroyo Grande recognized women in agriculture this week as part of International Women's Day. According to the 2017 Census of Agriculture, San Luis Obispo County has over 1,200 farms and ranches with a female principal operator, managing a combined 347,916 acres.
Also this week, local farmers, ranchers and ag businesses welcomed news from SLO County Public Health that all food and agriculture industry workers can now register for a COVID-19 vaccine appointment.

Per county guidance: "SLO County residents who are eligible based on their work will be asked to bring a form of identification and a recent pay stub to verify employment in their sector." Editor's Note: SLO County Farm Bureau is working with the County to address problems this may create for many who are self-employed in agriculture who may not have this paperwork.
Is This Process Different Than the Farmworker Friday Vaccine Pilot Project?
- Yes. Individuals in agriculture should use the County's existing vaccine registration process at recoverslo.org/vaccine. To help lower barriers to getting farmworkers vaccinated, we are coordinating directly with employers and the County to facilitate holding large blocks of vaccine appointment slots at specially-designated times for farmworkers.
- If you are a farm labor contractor or have large numbers of employees that work in SLO County, please contact Brent Burchett at bburchett@slofarmbureau.org or 805-543-3654. The initial Farmworker Friday for March 19 in Arroyo Grande is already booked up (600 doses). If vaccine supply levels allow, the County plans to rotate this project between Paso Robles and Arroyo Grande every other Friday in coming weeks.
Where Else Can I Get a Vaccine?
- In addition to the County, Community Health Centers of the Central Coast (CHC) began to offer vaccines to farmworkers this past week. We are to working closely with CHC and others to get mobile, on-farm vaccine clinics going soon.
- Food & Agriculture Workers can make appointments through Rite Aid and CVS in Arroyo Grande. Pharmacies and other healthcare providers get vaccine supplies from a separate allotment than what County Public Health receives. http://ritea.id/california and https://www.cvs.com/immunizations/covid-19-vaccine
What is SLO County Farm Bureau's Role?

We continue to ask all ag employers (includes Farm Labor Contractors) to provide us their current contact information and an estimated number of employees who want to receive the vaccine by filling out our San Luis Obispo County Farm Bureau - COVID-19 Vaccine Distribution Survey for Agriculture Employers.
- As vaccine opportunities come available, we connect the agency (County Public Health and now also CHC) with ag employers in that area (South County or North County). To reach the largest numbers of workers as quickly as possible, we have prioritized employers that have the largest number of crew-based workers. For the County's first Farmworker Friday pilot project on March 19, we have helped coordinate scheduling for the actual block of vaccine appointments. We are transitioning this process to have County staff (and also now healthcare partners) to take the lead on all the final coordination with the employer.

In partnership with all of our Farmworker Task Force members, we reach out to all of these ag employers and attempt to provide multi-lingual education/outreach communicators (includes Promotores staff) to come on-site and hopefully increase the number of workers willing to be vaccinated. Federal Government News: American Rescue Plan and Farm Workforce Modernization Act Updates

American Rescue Plan
This week, the U.S. House of Representatives passed a $1.9 trillion pandemic relief package, the American Rescue Plan, which was passed by the U.S. Senate over the weekend and is expected to be signed by the President on Friday. As we went over the topline food and ag provisions on our county call last week, I wanted to send over the updated provisions that will be signed into law. A more comprehensive update can be found here. The bill includes $22.7 billion in agriculture and nutrition provisions with $10.4 billion specific to agriculture:
- Food supply chain resiliency – $3.6B;
- Funds to be used for commodity purchases, grants and loans to processors, farmers markets, producers and organizations to implement measures that will improve food and ag supply chain resiliency and help support worker protection (PPE) costs
- Animal monitoring and surveillance efforts – $300M;
- Overtime fee relief for small and very small federally inspected meat processors – $100M;
- Assistance for socially disadvantaged farmers – $5B;
- Food for Peace program – $800M;
- Rural development grants for rural health care – $500M;
- Extends a 15% increase in Supplemental Nutrition Assistance Program (SNAP) benefits
- Authorizes state and local governments to use funds received from the package for some infrastructure purposes, including broadband
Farm Workforce Modernization Act Update and Outreach
We anticipate the bill will come up to the House floor for a vote on Thursday, March 18th. At this time, the bill has an even number of Republican and Democrat Cosponsors. California is represented well with Rep. LaMalfa, Valadao, Lofgren, Harder, Panetta, Costa and Carbajal listed as original cosponsors. You can find additional cosponsors and bill information here.

Newsom Administration Announces New Vaccine Distribution Plan: In a new system to allocate COVID-19 vaccination doses released by the Newsom Administration today, 40% of available vaccine doses will be set aside for the hardest-hit communities according to the Healthy Places Index (HPI), doubling the current vaccine allocation for these communities. As greater numbers of people are vaccinated in areas with lower incomes and higher rates of infections, counties will be permitted to re-open businesses and other activities more quickly than currently envisioned. The state will determine an allocation formula where communities most impacted by COVID-19 receive more vaccines.

Cal/OSHA Issues More COVID-19-Related Citations: On February 4, 2021 and again on March 2, 2021, Cal/OSHA issued multiple citations for various COVID-19-related Injury and Illness Prevention plan, Respiratory Protection plan and other regulatory violations. These citations were announced after the introduction of Cal/OSHA COVID-19 Emergency Temporary Standard, but appear not to cite that standard.

CA Supreme Court Outlaws Meal Period Rounding: In a ruling issued February 25, a unanimous California Supreme Court ruled that use of rounding of meal period start and stop times is impermissible under California law, and that employer's records that do not reflect a compliant meal period raise a rebuttable presumption of non-compliance. In Donahue v. AMN Services, LLC, the court rejected reliance on rounding in the context of meal periods, saying that "health and safety concerns" that underlay the requirement to offer meal periods "distinguish the meal period context from the wage calculation context, in which the practice of rounding time punches was developed...even relatively minor infringements on meal periods can cause substantial burdens to the employee."
