As you know, the boater Plaintiffs have proceeded with the Appeal of the Summary Judgment regarding the excessive slip fees being charged in Dana Point marina. (The lower court Judge had tried to short-circuit the lawsuit by finding that boaters were not beneficiaries of the lease of the Marina, even though the Marina was built specifically for the boaters.) There are four experienced attorneys working on the appeal for the boaters. All the initial documents necessary to perfect the appeal have been filed. Counsel is presently putting together the document record for the three-member panel of appellate judges. The record is extensive and may result in considerable expense.

On a sad note, Wayne Addison, one of the founders of S.O.S. (Save our Slips), passed away last week. He and George Hughes were big supporters and cheerleaders of grassroots efforts to keep boating affordable in Dana Point. A long-time boater in the Dana Point Marina, Wayne was an avid and experienced sailor and a member of the Dana West Yacht Club. A proud U.S. Marine veteran, he retired and took “live-aboard” status on his sailboat some years ago. Wayne was a dedicated and articulate advocate for boater’s rights. Wayne will be missed, but his spirit remains to root us on. Keep Wayne in your prayers, and his passion in your hearts. We all need to continue the good fight!
