Why It Pays to Trust Your Commercial Property Tax Protest to a Professional

NAR Defends Home Equity Interests Before the Supreme Court

On March 6, NAR filed an amicus brief in a case pending before the Supreme Court of the United States in Tyler v. Hennepein County, a case involving a Minnesota statute that allows the government to seize a homeowner’s property to satisfy a government debt and keep any surplus from the sale in excess of the debt owed as a windfall.

NAR, along with the American Property Owners Alliance and the Minnesota REALTORS®, filed the amicus brief in support of the property owner’s entitlement to the surplus equity, arguing the state statute effectuates an unconstitutional taking of private property under the Fifth Amendment. NAR urges the Supreme Court to reject the Eighth Circuit’s decision and the problematic state foreclosure statute in favor of upholding constitutionally protected private property rights.
NAR Comments on NFIP Reauthorization and Reform 

On March 8, 2023, NAR submitted a statement supporting the National Flood Insurance Program (NFIP) reauthorization and reform legislation for a hearing convened by the House Financial Services Subcommittee on Housing and Insurance. Within the letter NAR requested:

  • Reauthorize the NFIP for five years. Congress has passed 25 short-term NFIP extensions since 2018, increasing uncertainty in real estate markets and risking 40,000 home sales each month. It is time for Congress to come together and support a long-term NFIP reauthorization with meaningful reforms to modernize mapping, incentivize risk mitigation, and strengthen consumer choice between NFIP and private flood insurance.
  • Encourage a more robust private market to help close the flood insurance gap. According to FEMA, less than 4 percent of U.S. homes are covered by flood insurance. Removing two regulatory obstacles to private flood insurance would help close the gap: • Clarify that federal continuous coverage requirements can be satisfied by NFIP or private flood insurance and Refund NFIP premium when there is a duplicate private flood coverage.
U.S. House of Representatives Blocks Biden WOTUS Rule

On Thursday, March 9, the U.S. House of Representatives passed H.J. Res. 27, a joint resolution of disapproval under the Congressional Review Act (CRA) on the Biden Administration’s flawed and burdensome “Waters of the United States” (WOTUS) rule. This legislation was led by Committee on Transportation and Infrastructure Chairman Sam Graves (MO-06) and Water Resources and Environment Subcommittee Chairman and Western Caucus Member David Rouzer (NC-07).

The resolution passed with a bipartisan vote of 227-198. NAR supported this CRA joint resolution. The House Joint Resolution, if enacted, would terminate the Biden WOTUS rulemaking utilizing the CRA, which provides a mechanism for Congress to overturn certain final agency actions. An identical measure was introduced in the Senate by 49 Senators, led by Environment and Public Works Ranking Member Shelley Moore Capito (R-WV) and may be voted on a soon as next week.

TREPAC Night at the Missions Game
 
Come out to the ballpark on Friday, May 12 to support TREPAC and cheer on the San Antonio Missions as they play host to the Corpus Christi Hooks. The event will be on the San Antonio Missions Fiesta Deck, an all-inclusive, private, multi-level deck at Wolff Stadium. Tickets are $40 for adults and $20 for kids 12 and under.

Each ticket purchase will include all-you-can-eat hamburgers, hot dogs, beef and chicken fajitas, and a nacho bar. Plus, snack on popcorn, cookies, and chips and salsa throughout the game.
