News from Virginia DEQ
The results of the periodic review of the Virginia Solid Waste Management Regulations (VSWMR – 9 VAC 20-81) is complete.  Click here to see a report of the results. 

Since the result of the periodic review is to amend the regulation, DEQ is in the process of preparing a Notice of Intended Regulatory Action (NOIRA). The NOIRA is required to be approved by the Governor's office before the agency can proceed with publishing the NOIRA. Once the NOIRA is approved by the Governor's office the NOIRA will be published in the Virginia Register. There will be a Regulatory Advisory Panel (RAP) to develop amendments to the regulations.

How Regulation of CCR Has Impacted Landfills and Environmental Industry

History of CCR Regulations

Federal Coal Combustion Residuals (CCR) Rules were first proposed in 2010. In 2014, the EPA finalized the CCR Rules and established technical requirements for CCR landfills and surface impoundments (i.e. coal ash ponds) under Subtitle D of the Resource Conservation and Recovery Act (RCRA), the nation's primary law for regulating solid waste. The Rules became effective on October 19, 2015, and contained aggressive deadlines for siting, permitting, and constructing CCR landfills, as well as for closing surface impoundments. However, the Federal Rules did allow in-place closure of surface impoundments. 

The Federal Rules affected hundreds of coal powered plants across the country. Some utilities have sufficient land to build landfills on their own property. In order to meet the aggressive deadlines set forth in the Rules, utilities accumulated mass quantities of HDPE liners and other geosynthetic materials that are used in Subtitle D landfill bottom liner systems. They also had to perform hydrogeologic studies and establish groundwater monitoring networks for each new landfill.

Driving is something most of us do—hopefully safely—every day. And while we spend about 99 percent of that time moving forward, we have an estimated 25 percent of our accidents during the one percent sliver of time we spend backing.

The National Safety Council attributes 500 deaths and 15,000 injuries per year to backing accidents. This year alone, five solid waste collection workers in the U.S. were killed by the vehicles they were working on the back of. Just last month, a pedestrian died after being backed over by a trash truck operating in her Newport News neighborhood.

Factors contributing to backing accidents include:

·        Physical obstructions
·        Distracted drivers
·        Distracted pedestrians, cyclists, etc.
·        High activity areas/objects moving into backing pathway
·        Low visibility conditions due to weather, poor lighting, etc.
