Assembly Bill 939, introduced by Senator Weiner of San Francisco and co-authored by Senator Lena Gonzalez, is going to committee for review.  Attached is a complete copy of the b il l , as revised. This bill includes drastic measures that can put commercial real estate, as we know it, at risk. We have yellow highlighted two (2) very important sections, that provide for the following:

  • Requires all Lessors in California to defer lessee rent obligations for one (1) year.
  • Allows certain types of business to terminate their lease and walk with no responsibility for the on-going lease obligations.
  • Uses the COVID emergency to up-end your leases.

We have also attached an Analysis and Comments provided by California Business Property Association, the industry lobbyist for BOMA, NAIOP and ICSC, among others.
