AB Reminder: Directive 040 pressure requirements 

Directive 040 requires that annual pressure and testing surveys be completed by December 31, 2024 and submitted by March 31, 2025. 

Failure to obtain and submit the required pressures and, in some instances, fluid analysis, will result in a $1000 administrative penalty (fine) plus you will still have to obtain and submit the test data to fulfil the 2024 requirement. Contact us if you require assistance requesting a waiver.

AB: Updated Requirements for Unpaid Municipal Property Taxes

Effective September 15, 2024, and in accordance with Ministerial Order 096/2024, the AER will continue to require evidence that licensees have resolved unpaid property taxes exceeding a threshold amount before approving a new well licence application under Directive 056: Energy Development Applications and Schedules, Directive 089: Geothermal Resource Development, and Directive 090: Brine-Hosted Mineral Development or a well licence transfer application under Directive 088: Licensee Life-Cycle Management.


The threshold for municipal tax arrears remains at $20,000. Listed licensees must continue to provide satisfactory evidence to the AER that arrears exceeding the threshold have been paid or that a payment arrangement has been made with the municipality or municipalities to which the arrears are owed. 


It is the licensee’s responsibility to gather and submit evidence when requested by the AER as part of the application process. For well licence transfer applications where the transferor is listed, the applicant must provide evidence that payment of municipal taxes exceeding the threshold is a condition of the purchase and sale agreement with the transferee.

AB: OneStop Update

On October 17, 2024, the AER will release new functionality to the OneStop platform: Record of Site Condition (RoSC)


Notice of Contamination, a new submission intent, is being added to the RoSC module to meet release reporting requirements under the Environmental Protection and Enhancement Act, section 111 and Release Reporting Regulation, section 4. The Notice of Contamination may be used for unreported, lower-risk substance releases that are not related to an ongoing incident.


Manual 018 Public Lands Application is being updated to reflect minor enhancements in the public lands module, policy changes, and increased clarity.

AB: Invitation for Feedback on Revised Liability Directives

The AER is seeking feedback on updates to the following directives:

• Directive 001: Requirements for Site-Specific Liability Assessments

• Directive 011: Estimated Liability (previously Licensee Liability Rating (LLR) Program:


Updated Industry Parameters and Liability Costs)

• Directive 088: Licensee Life-Cycle Management

• Directive 068: Security Deposits


The draft directives are available on the “Directives” page of the AER website, under the “Draft / Open for Comments” tab. Deadlines for feedback are shown for each. To provide feedback on the proposed revisions, complete the public comment form on the AER website

MB: Petroleum Fiscal Regime Changes Industry Consultation

A new Petroleum Fiscal Regime is being recommended for Manitoba Petroleum producers. The new fiscal Regime includes the following:

- A new structure for Freehold Production Tax and Crown Royalties,

- Manitoba Dilling and Major Workover Incentive (MDWIP),

- Infrastructure Development Incentive Program (IDIP).


Initial industry consultation includes the following:

- October 3, 2024, 4:00-5:30PM (CDT). Initial meeting via Teams for all interested parties.

- October 15, 2024, 9:30AM – 4:30PM (MDT). In person training session o 1060 – 717 7th Avenue Explorers and Producers Association of Canada.

- October 17, 2024, 9:30AM – 4:30PM (CDT). In person training session o 295 3rd Avenue, Virden, MB R0M 2C0 Tundra Oil & Gas.

SK: Notifications

·       Beginning in October 2024, there will be changes to the look and function of obligations that relate to cut and cap operations reported in IRIS (i.e. Report Cut and Cap obligation (due 12 months after downhole abandonment), as well as the Submit Cut and Cap Report obligation (due 7 days after the cut and cap operation).


·      Multiple notification related updates are now available in IRIS: notification tracking fix, creation of notification type Obligation Due Date Reminder, and amendment to Notification Preferences functionality.

BC: Changes to Process for Submitting Road Notifications 

Effective Nov. 4, 2024, information currently submitted to ExternalNotifications@bc-er.ca using either the Notice of Intent to DeactivateStatement of Road Deactivation or the Road Notification form, must be submitted via the eSubmission portal.



Road Notifications will also be made through eSubmission. If there is not an active Road Permit, an application to obtain a road permit must be submitted prior to the Road Notification.

BC: New eSubmission Forms for Certificates of Restoration  

On September 20, 2024, the BCER has introduced a new online submission portal for regulatory submissions for Certificate of Restoration – Part I & Part II, and Dormancy and Shutdown Assessment Forms.


Information on where to access the forms and how to make the submissions is available in the eSubmission User Guide. Additional updates and forms for pipelines and standalone facilities will follow at a later date.
