PARTNER'S PERSPECTIVE
Charles B. Jimerson - Reflections on Grief and Mending Fences
It is a sad fact of life that all of us will have to experience draining, comfortless grief in our lifetimes. Losing a loved one or an impactful kindred soul is never a hospitable escapade. As a country, it feels we are becoming immune to the shared human experience we are all undergoing and callous to its ultimate deliverance. In life or death, the ability to take another’s perspective and understand the impact of your own actions appears to be ebbing. Despite life giving us endless opportunities to teach love, empathy and human reverence, we are losing track of our own role in putting forth that critical catalyzing effort. It takes nothing to care about the well-being of another, to hold space with them, withholding judgment, emotionally connecting, and communicating that incredibly healing human message that you are loved and you are not alone. True human connection with someone, even our foe, is a ladder out of the hole we are all in. Why don’t we do this every day?

Recently I lost a close loved one who died unexpectedly at a very young age, and it was a stark reminder of how loosely we hold on to the things we love and the things we never want to lose. No farewell words were spoken, no time set aside to say goodbye, she was just gone before we knew it. My family got no choice in the matter. Because we loved, now we grieve. For me, the grieving process has caused meaningful reflection on the things that matter most in life and the measurement of a life well lived. My grief will soon turn to gratitude and a renewed passion for life. I recently read a philosophical remark that grief can't be shared, and that everyone carries it alone, holding their own burdens in their own way. While I’ve found that this is often true, it doesn’t always have to be that way. People are lonely and in pain because they build walls instead of bridges.

Whether grieving or not, I think we all could use more friends these days. Friendly presence and encouragement is more important than it seems. Accepting that we can’t change one another and that, most of the time, we can’t fix the situation, will make us all feel better. When you stop expecting people to be perfect, you can like them for who they are. Embrace the glorious mess that they are, and beg them to accept you. For anyone who is still reading this preachy salvo, I’m going to land the plane now. But first, I’ve got a very basic, very fourth grade request of you. Please do it as a personal favor to help me get through my grieving process. Sometime in the next week, I ask you to reach out to someone you haven’t talked to in a while, or even better, someone you are at odds with, just to tell them how much you care about them as a person. How much you root for their success and happiness. Whenever you’re in conflict with someone, there is one factor that can make the difference between damaging your relationship and deepening it. That factor is effort. Make it happen. Do it big, too. Shock them. In the process, let go of who you think they are supposed to be, and who you think you are supposed to be, so that you are both enabled to accept who you are. In doing so, you will both carry on. And carrying on these days is our own shared superhuman achievement.

Very truly yours,
Charles B. Jimerson

Wahl Leads Training Opportunities for Virtual CAI Education Program
Partner Hans C. Wahl presented two training opportunities for the Northeast Florida Community Associations Institute's (CAI) virtual educational program for Community Association Managers (CAMs) that spanned multiple days in September. His two courses, Developer Turnover for Community Associations and Emergency Powers and Hurricane Preparedness, offered participants legal insight and best practices during each of the two-hour Florida DBPR-approved courses.

CAI selectively chose presenters and topics for their "Wham Bam Educational CAM" program that would offer "leading-edge ideas and inspire enlightening discussions." Member surveys, success of previous presentations and relevancy of topics to the community association industry also factored into their decision.

If you are interested in an educational presentation for CAMs/staff at your company or for board members at your association, please call 904-389-0050 or email us. To learn more about how our firm serves the Community Association Industry, click here.

Florida's Fast-Track Residential Foreclosure Process

Since 2013, residential foreclosure actions in Florida have been significantly shortened—from over two (2) years to possibly less than six (6) months—because of the new “fast-track” process provided in section 702.10, Florida Statutes. This fast-track foreclosure process starts with the filing of a “verified” foreclosure complaint that sufficiently alleges standing, along with a certificate of possession of the original promissory note or a lost note affidavit, followed with a request for an order to show cause...

Five Key Tips for Construction Delay Claim Success

Delays are sometimes unavoidable on construction projects. When delays occur, they can often result in increased costs to contractors and subcontractors, and may bring exposure to owner claims for liquidated damages for delay.  Certain types of delays, such as those caused by circumstances beyond the contractor’s control, may be deemed excusable delays and entitle the contractor to time extensions, thereby avoiding liquidated damages. Certain types of excusable delays, such as those caused by some action or inaction of the owner for example, may also be considered compensable delays that entitle the contractor to compensation for the additional costs of the delay, as well as a time extension for the delay...

Understanding the Difference Between Condominium and Homeowners' Association Turnover

At first blush, one may conclude that condominium associations and homeowners’ associations would have the same or nearly identical requirements for when turnover occurs. However, the truth is quite opposite. Florida condominium association are governed by Section 718, Florida Statutes compared to Florida homeowners’ associations, which are governed by Section 720, Florida Statutes. With that being said, Chapter 718 is more rigid on Condominium Associations compared to the statutory requirements for Homeowners’ Associations under Chapter 720 and imposes different time periods for when turnover of a Condominium Association may occur...

Commercial Mortgage Default Options Including Acceleration and Enforcement of Personal Guaranties

In reviewing a loan file after a default by a borrower, lenders should evaluate whether the loan includes an acceleration clause and whether the loan is secured by any personal guaranties. With commercial loans, typically the loan documents will include an acceleration clause, which allows the lender to accelerate all or most of the remaining amounts due under the loan. The loan documents also typically include one or more personal guaranties...

An Inside Look at the Jimerson Birr Summer Associate Program
As the summer comes to a close, the 2020 Summer Associate Program is wrapping up in a unique way. Pierce Schultz, JD Candidate 2021, and Stewart Subjinkski, JD Candidate 2021, spent the past few months working with our attorneys on a variety of dynamic cases and projects. We were impressed with their capabilities and personal accountability. As a result of safety precautions and attendance flexibility implemented at schools across the country, Pierce and Stewart will be tackling both their first semester of their 3L year virtually while working at the firm part-time.

We are also excited to announce that we are in the process of procuring our next class of Summer Associates. This will be an ongoing endeavor through the spring of 2021. To learn more about our program, click here.

Finally, Jimerson Birr is wishing all of the recent graduates taking the Florida Bar this October the best of luck.
