CHAIRMAN'S CORNER
Hello my fellow members and welcome to this edition of the TTA Newsline. I’m extremely excited as we are in early September and only a couple of weeks out from the Annual Convention. I am looking forward to seeing old friends and colleagues and eager to make new connections as well.

This will be my last contribution to the TTA Newsline as this is the end of my two-year term as your chairman (I can hear the collective sighs of relief from everyone). It appears I am being forcibly removed from office by bureaucracy and possibly some election interference from the likes of Arkansas or Mississippi and replaced by Mr. Jason Higginbotham with Ozark Motor Lines out of Memphis. 

In all seriousness, it has been an absolute honor and privilege to serve as chairman of such an outstanding organization and I know that Jason shares the same sentiments as he takes the gavel. He is the second generation of Higginbotham’s to serve as chairman of TTA following in his father’s footsteps just as I did. I look forward to his great leadership and will do everything I can to support him and the TTA moving forward.

To briefly comment on these past two years, I can’t shower enough praise on the staff at TTA. The association confronted the unknowns of the pandemic, successfully transitioned our Presidential leadership from Dave to Donna, and emerged a stronger association in this post-pandemic world.

To Donna, Carol, Catherine, Ashlee, and Marty, I am grateful for your perseverance, passion and leadership throughout some of the most pivotal times our association has faced. 

In addition to the staff at TTA, I can’t say enough good things about the brilliant minds and resolute leadership on the Executive Committee of TTA and the Board of Directors at the Tennessee Trucking Foundation. Our members can be confident these outstanding men and women can take on any challenge that may be down the road.

Thank you and I look forward to seeing everyone in Destin!

CATHERINE STUART, TENNESSEE TRUCKING FOUNDATION COORDINATOR, RECEIVES 2022 TENNESEE HIGHWAY SAFETY OFFICE DIRECTOR'S AWARD
The Tennessee Highway Safety Office Director’s Awards were created to recognize outstanding efforts by partners of the THSO in a wide variety of disciplines. All of THSO's partners are extremely important, and the ones that are chosen to honor each year exemplify exceptional performances of passion and dedication to saving lives. These efforts have given reason to recognize their “best practices”—practices that have led to a reduction in crashes and/or lifesaving methods, helping the State of Tennessee achieve continued success. Catherine was presented this award at the 34th Annual Tennessee Highway Safety Office Lifesavers Conference in August. Catherine started with the Tennessee Trucking Association in 2007 and began her role as Foundation Coordinator in 2015. As Foundation Coordinator, Catherine oversees the coordination and training of the TN Road Team Captains and has grown the THSO partnership with programs such as Yellow Dot and CarFit. Catherine has had outstanding growth and demand for Road Team Captain events and has provided significant numbers of registrations for Yellow Dot and CarFit. She created the roles of ambassadors among the Road Team Captains and ensured that each Regional Leadership had a trailer to meet their needs in order to successfully implement the older driver initiatives. Her efforts have positively affected untold numbers of older drivers in rural and metropolitan areas allowing them to maximize safety in their vehicles.

"We are very proud of Catherine for her hard work and dedication to the Foundation. Catherine is so deserving of this award and it was exciting for us to attend the ceremony and watch her accept this honor in front of her friends, family, and TTA co-workers," says Donna England.
COLONIAL FREIGHT SYSTEMS, INC.
Yes, it’s true; Colonial Freight Systems, Inc. of Knoxville, Tennessee is closing after almost 80 years. However, this is not the case of “another one bites the dust.” The owners have simply decided to retire. Colonial has had many wonderful profitable years and has continued to thrive during and through Covid-19.

The unprecedented market for used equipment provided the opportunity for the McBride’s to take advantage of the timing for their retirement. Tom and Ruby McBride have been running Colonial for the past 25 years (Tom for 17 years and then Ruby for the last eight and a half) with the help of their many dedicated and loyal employees, agents and lease operators. Colonial will stop delivering freight at the end of August because that is when the tags expire. However, the office will remain open until all bills have been paid and all business has been handled.

Colonial has transitioned some of their dedicated divisions and lease operators to Purdy Brothers in Loudon, Tennessee. Employees are being paid a severance and Colonial is assisting in transitioning employees and remaining lease operators to other companies. Words cannot describe what an amazing family of dedicated employees, agents and drivers that Colonial has been blessed with over the years. We want to extend special thanks to all of our customers, lease operators, agents, employees and business partners who have stood with us over the years and through this transition to retirement. You truly are “our family”.

Clarence Elbert McBride (Colonial’s founder) began his first venture into “For-Hire Transportation” at the age of six. A nearby neighbor had a billy goat with a cart which Clarence overheard him to say he wanted to sell. Having seen his father write checks at the local bank, Clarence understood at that early age that there was a connection in commerce and the little slips of paper at the bank. He promptly asked the neighbor to accompany him to the bank so he could purchase the goat and wagon. The neighbor, being both amused and impressed, decided to go along with this dead serious child. So, at the bank, Clarence, who had not yet learned to write, picked up a blank check, made a scribble across the check and the deal was struck. Later, the neighbor presented Mr. McBride, Sr. the check with the demand for $6.00. Naturally, Clarence got a thrashing that night, but he was allowed to keep the goat and wagon. He promptly contracted with the local railroad station to haul the mail from the depot to the local post office. His love for transportation continued from that moment all through his life until he passed away
in 1996.

GILES COUNTY ROADSIDE INSPECTION
You are invited to participate in a Roadside Inspection conducted by the Tennessee Trucking Association in conjunction with the Tennessee Department of Safety on Wednesday, September 28th, at the Giles County Scales on I-65 North, mile marker 5 out of Alabama – northbound side.

Participants will divide into teams and a State Trooper will be assigned to lead each team. Teams work with the troopers as they pull vehicles in for inspections. Level I, II and III inspections will be conducted. It is the best educational experience a company can have regarding how roadside inspections are conducted. You will see what might prompt a vehicle to be pulled in, what determines the level of inspection to be performed, and what is expected when paperwork and equipment is checked. This facility has a weigh-in-motion (WIM) scale along with a DOT reader, license plate reader, over-height, length, width detector and a Performance based brake tester (PBBT). We are very excited about this opportunity to work with the Department of Safety again at this facility.  The event begins at 8:00 am Central Time and concludes around 2:30 pm or 3:00 pm with a summary of the inspections conducted throughout the day. You don’t have to be a member to participate. There will be several “visitors” present. If you can possibly get away, I think you will find it to be a very enlightening experience. Even if you can’t make it, please try to send someone from your company who works with log records, safety or maintenance. We have had company owners, administrative personnel, dispatch, maintenance, etc., participating in the past. All have gone away with valuable experience. 
GREENEVILLE ROADSIDE INSPECTION
The Greeneville Roadside has been rescheduled
from August 26th to Friday, September 30th.

Greene County Roadside Inspection will be conducted by the Tennessee Trucking Association in conjunction with the Tennessee Department of Safety on Friday, September 30th, at the Greeneville Scales on I-81 South, MM 21.

FMCSA UPDATES SMS WEBSITE, FMCSA ENHANCES DATAQS WEBSITE, REMINDER: EMPLOYERS MUST PROVIDE LIST OF SAPS TO EMPLOYEES WHO INCUR DRUG AND ALCOHOL PROGRAM VIOLATIONS
FMCSA Updates SMS Website

FMCSA has updated the SMS Website with the July 29, 2022 results. Complete SMS results are available to enforcement users and motor carriers that are logged into the SMS Website.

Note: The previous monthly email stated that ELD violation 395.24(d) would be added to SMS as of July 1, 2022, and would be reflected in the July 29, 2022 snapshot. This update has been postponed, and no changes have been made to SMS for this snapshot. FMCSA will provide an update at a later date.

FMCSA Enhances DataQs Website

On August 1, 2022, FMCSA released enhancements to the DataQs website in response to user feedback. This release includes an updated homepage and registration process, revamped submission tool, and a new mobile-friendly design. Future releases are planned to enhance the other areas of the website. DataQs is an FMCSA system that allows users to request and track a review of Federal and State data issued by FMCSA believed to be incomplete or incorrect. It enables all users to improve the accuracy of FMCSA's data-driven safety systems that help prevent crashes, injuries, and fatalities related to commercial motor vehicles. Motor carriers log in with your FMCSA Portal username and password, and drivers log in with a DataQs username and password. Visit DataQs at https://dataqs.fmcsa.dot.gov to learn more. DataQs is also the system for submitting eligible crashes to the Agency’s Crash Preventability Determination Program.

Reminder: Employers Must Provide List of SAPs to Employees Who Incur Drug and Alcohol Program Violations

A driver with a verified drug and alcohol program violation is prohibited from performing safety-sensitive functions until he or she completes the return-to-duty (RTD) process. The RTD process is initiated by an initial assessment completed by a substance abuse professional (SAP).

Per § 40.287, if an employee (including an applicant or new employee) violates a USDOT drug and alcohol regulation, the employer must provide a list of acceptable SAPs readily available to the employee. The list must include SAP names, addresses, and telephone numbers. Employers cannot charge the employee any fees for compiling or providing this list, and they may provide this list themselves or through a C/TPA or other service agent.

NATIONAL TRUCK DRIVER APPRECIATION WEEK
SEPTEMBER 11-17, 2022
Nearly every aspect of daily life is made possible because a truck driver delivered the goods and resources people need.

National Truck Driver Appreciation Week is an important time for America to pay respect and thank all the professional truck drivers for their hard work and commitment in undertaking one of our economy's most demanding and important jobs. These 3.6 million professional men and women not only deliver our goods safely, securely, and on time, but they also keep our highways safe.

This year's National Truck Driver Appreciation Week is September 11-17, 2022. 

Americans in all fifty states have taken extraordinary steps to show their appreciation for the important work that professional truck drivers have done as we navigate our way through the coronavirus pandemic. From children passing out lunches, to "I Heart Truck" signs across America's highways, the public has taken notice of the essential role truck drivers to play in their lives. 

This week is a way to show appreciation to the 3.6 million professional men and women who not only deliver our goods safely, securely, and on time, but also keep our highways safe.

TIPS TO AVOID ROAD RAGE

Professional truck drivers spend much more time on the road than the general public. As a result, they are more likely to be confronted with aggressive situations involving other drivers. Here are six tips for avoiding or managing road rage.

Managing road rage starts with a calm and relaxed attitude. Give yourself as much time as possible to make your trip and remember that you’re going to get there anyway, so make the trip safely. Be resilient and don’t overreact to other drivers’ mistakes.
 
Your reaction
If someone makes an inappropriate gesture, cuts you off, or tries to pull you into some kind of action, don’t react. If necessary, slow down or change your route to avoid the other driver’s anger. You have no control over their behavior. However, you can manage your reaction.
 
Stay Calm
If you notice another driver starting to show signs of aggression, leave space between your vehicles and avoid eye contact. Don’t engage in the exchange of hand signs or profanity.
 
Be Courteous
Lead by example and show courtesy and politeness on the road. Let your intentions be known. Use turn signals, don’t follow too closely behind the vehicle in front of you, don’t hang around too much in the passing lane, don’t hog the lane, and drive at a steady speed.
 
Sleep and Eat Well
A driver who has not had enough sleep will be more irritable and may get carried away more easily. Hunger also has a negative effect on mood, ever been ‘Hangry”? Good rest and good nutrition help you stay calm in the face of bad situations on the road.
 
Report Aggressive Driving to Police
If there is a conflict and it seems it may get out of hand, call 911 immediately. Be sure to lock your doors and close your windows. Never get out of your vehicle to try to calm the person who is angry with you. Just wait for the police to arrive. Write down the vehicle’s license plate number, make, type, and color. This will greatly assist the police if the suspect leaves the scene before they arrive.

BREAKING: FORMER TENNESSEE HOUSE SPEAKER CASADA, CHIEF OF STAFF ARRESTED BY FBI FOLLOWING FEDERAL INDICTMENT ON THEFT, KICKBACKS, MONEY LAUNDERING
 
In a development that has been brewing for some time, former Tennessee House Speaker Glen Casada and his former Chief of Staff, Cade Cothren, were both arrested by FBI agents at their homes at 7 a.m. last Tuesday morning. The arrests come in the wake of a 20-count federal indictment charging the two with conspiracy to commit the crimes of theft, wire fraud, bribery/kickbacks, and money laundering. If convicted, the charges carry maximum sentences of 20 years in prison. Both Casada and Cothren appeared in court following their arrests, where they pled "not guilty," and in a comment to the media Casada’s attorney promised to mount “a vigorous defense” to the charges. They were released from custody on Tuesday.

ANNUAL SILENT AUCTION
We are tremendously excited for this year’s 92nd Annual Convention on September 18-20, 2022. We are over halfway through 2022 which means we have started preparing for the Convention’s Silent Auction and collecting donations. We would greatly appreciate any donation you or your company could offer. Bidding will be on an online platform again this year, but items will be in person at convention. This way, even if you can’t attend convention, you can still bid from home! This year our Auction Committee will be Committee Chair Greg Shipman, Vertical Alliance Group, Perry Wilson, McKee Foods Transportation, LLC, and Matt Holmes, Southern Champion Tray, LP. The annual silent auction is one of our largest fundraisers which helps us promote safer highways in Tennessee.
