    HALACHA INSTITUTE Q&A

            By Rabbi Yehuda Kraft

Q: What is the Halacha in the following scenario: Someone is sitting at a meal and suddenly the neighbors send over leftovers from their family Simcha. Alternatively, a family member comes home with the shopping from the supermarket. Is a new Bracha required on the new food, or is it exempt with the original Bracha recited at the beginning of the meal?

A: The Shulchan Aruch ( קעז ,ה ) says that a new Bracha is required in these cases because it is assumed that when they are reciting the original Bracha they do not have in mind to cover unexpected food. However, the Rema says that the custom is not to recite a new Bracha. This is because when sitting at a meal, one has Daas (intent) when reciting the Bracha to cover any food that may later come to enhance his meal. However, if someone is merely eating a snack all agree that the Daas at the time of the Bracha would not necessarily cover all new foods that came unexpectedly.

Hence the Ashkenazi Minhag is to be lenient. Therefore, when partaking of a meal one would not recite a new Bracha over unexpected food, whereas the Sephardic Minhag is to recite a new Bracha. If, however, it is commonplace for the above scenarios to occur, then all agree that no new Bracha is required.
