The Coop Compensation Amount field in Flex replaced the two Buyer Broker Compensation and Transaction Broker Commission fields. This change occurred earlier this year to coincide with the contract change. The “Coop Compensation Amount” field is found when entering a listing in Flex.
Section 7.1.1 of the Exclusive Right to Sell Contract Reads:
7.1. Amount. In consideration of the services to be performed by Broker, Seller agrees to pay Brokerage Firm as follows:
Sale Commission. (1) _______ % of the gross purchase price or (2) __________ in U.S. dollars.
Brokerage Firm agrees to contribute from the Sale Commission to outside brokerage firms’ commission % ______ of the gross purchase price or _______, in U.S. dollars.
The “Coop Compensation Field Amount” should be completed with the percentage or dollar amount from the second sentence of the paragraph describing the outside brokerage firms/ commission. This is the offer of compensation the listing agent is offering to co-op (buyer) brokers in the MLS.
Please remember the VMLS shall not fix, control, recommend, suggest, or maintain commission rates or fees for Services to be rendered by participants. Further, the VMLS shall not fix, control, recommend, suggest, or maintain the division of commission or fees between cooperating participants or between participants and non-participants.
Furthermore, the VMLS does not have a rule requiring the listing broker to disclose the amount of total negotiated Sale Commission from the listing contract. The VMLS shall not disclose in any way the total commission negotiated between the seller and the listing broker.
