Join OHC's Legislative Affairs Committee and Help Us Help Horses & Our Equine Community

The Oregon Horse Council works hard to maintain the rights of equestrians across Oregon, but with progressive movement to decrease our trail access, eliminate our land, stop the usage of animals for sport and pleasure and much more – we need to increase our voice! We are excited to launch a Legislative Affairs Committee who will assist our board with taking a stand against the legislation that can negatively impact our industry’s way of life. We invite you to apply to join our committee!

Action Request

February 22, 2024 by Oregon Equestrian Trails

Not addressed by the legislature so far. Still keep watch for this, and write to your legislators.

The Oregon Legislature is about to vote on a critical topic for equestrians. Please send a short email to your state legislators (you have two of them) and ask them to vote FOR the legislation.

The Situation: A recent court case gutted Oregon’s recreational immunity law, which encouraged landowners to open lands to the public for recreational use by protecting the landowner if a recreational user sought damages after an injury. Because of the lack of recreational immunity, parks and municipalities across the state have closed trails. If the Oregon legislature doesn’t pass a new recreational immunity law, more trails will close.

The New Recreational Immunity Law: SB 1576A is emergency legislation that’s under consideration during this year’s short legislative session. It reinstates recreational immunity until January 2026, which gives the legislature time to craft a permanent fix in the 2025 full legislative session. All fifty states have enacted laws that provide liability protection to landowners who allow the general public to use their land for recreational purposes.

Find your legislator: To find the name and email address of your legislators, go here: https://geo.maps.arcgis.com/apps/instant/lookup/index.html?appid=fd070b56c975456ea2a25f7e3f4289d1. Type your zip code in the “Find Address” box at the top left. You’ll find the names and email addresses of your state senator and state representative. Copy the email addresses and paste them into an email, compose your message, and hit Send.

What to say in your email: Here’s sample language you can use:

Dear [Sen. or Rep ____]

I am an equestrian trail rider from [name of your town], and I urge you to vote in favor of SB 1576A with the -10 amendment. In addition, please modify Item 5 in Sections 6 and 9 to specifically include horseback riding.

I support this legislation because [pick one or two]

  • Being able to ride my horse on the trails on our public lands is important to me.
  • SB 1576A’s recreational immunity provisions are critical to keeping our trails open, reversing recent closures, and keeping local trail improvement and development projects on track.
  • Recreational immunity laws are the foundation of our healthy outdoor recreation economy. Recreation employs hundreds of thousands of people and brings in $200 billion annually to our state. Without strong recreational immunity protection, Oregon will lose billions of dollars in revenue and tens of thousands of good-paying jobs.
  • All fifty states in the U.S. have enacted statutes that confer some degree of liability protection to landowners who allow the general public to use their land for recreational purposes.

Please pass SB 1576A with the -10 amendment that restores recreational immunity for public and private landowners and applies to both improved and unimproved trails. Also, please modify Item 5 in Sections 6 and 9 to specifically include horseback riding.

Your Yes vote will provide hundreds of thousands of Oregonians the continued access and use of our trails, and give landowners the protection they need. Thank you for your consideration.

Sincerely,

[Your name and contact info]

AMHA Offering PSSM1 Testing

The Registry Committee and AMHA Board voted unanimously during their Third Quarter Board of Directors Meeting to approve offering PSSM1 testing immediately to assist breeders in making informed decisions for their breeding program. These results will be incorporated into the horse’s profile and the results available through the online database or by calling AMHA.

The fee for PSSM1 testing is $45 per horse. A fee of $15 to record a Veterinary Genetics Lab (VGL) test previously recorded with VGL, once the identity of the results has been confirmed through VGL, was also established. The VGL test results done privately must accompany the application. The PSSM1 Testing Application and the updated Registration Application can be found HERE.

In addition, Rule 10 – Genetic Testing was added to the Registry Rules and Regulation.

RULE 10 – GENETIC TESTING

The Registry exists to preserve, promote, and perpetuate the Morgan horse. In furtherance thereof, the Registry desires to allow its members to conduct certain genetic testing on Morgan horses so that such members can make educated decisions regarding breeding Morgan horses in an effort to improve the strength, welfare, and integrity of the Morgan breed. Such genetic testing will be conducted in all respects in accordance with these Rules. All such genetic testing results obtained will be permanently recorded with the Registry, are the property of the Registry and may be used by the Registry for any and all purposes deemed appropriate by the Registry to perpetuate the mission statement and goals and objectives of the Registry from time to time, including, without limitation, research, education and analysis. All genetic testing will be under the supervision of the Registrar and will be done at the expense of the owner. The Registry reserves the right, in its sole discretion, to publish any and all genetic testing results with respect to each horse tested or broadly as part of studies or other breed analyses. Currently, any such genetic testing is optional and may be requested or conducted with respect to a horse by the registered owner or lessee of such horse.

Below is a list of currently permitted genetic testing:

  • Coat Color Testing
  • SynchroGait Testing
  • Polysaccharide Storage Myopathy (PSSM1)

Notice of Frozen Semen Transfer Updates

Over its past few meetings, the Registry Committee has been discussing whether the owner of frozen semen could request genetic testing on it through AMHA. The Registry’s longstanding policy is that only the owner or lessee of a horse can request genetic testing.

After discussing this with AMHA’s legal counsel, he suggested that this policy not change; however, the owner of the stallion selling the frozen semen could authorize the purchaser to request testing. The Registry Committee and Board agreed. This will be facilitated through the Notice of Frozen Semen Transfer form with the addition of a series of consent statements to which the stallion owner would check "yes" or "no."

If you are the seller of frozen semen, please make sure your intent is clear by checking the appropriate boxes on the form. The updated form is located HERE.

Should you need assistance, please contact the AMHA Registry Department at registry@morganhorse.com or (802) 985-4944 extension 2. Thank you!

Update to Registry Rule 5 -

Certificate of Registration

AMHA’s longstanding policy regarding multiple owners, as noted on the Transfer Application, has been: Unless otherwise requested, ownership of horses with multiple owners will be Joint Tenants with Rights of Survivorship.

During the recent AMHA Registry Committee and Board of Directors meetings, this was formalized by the addition of Rule 5-D to the AMHA Registry Rules & Regulations.

RULE 5 - CERTIFICATE OF REGISTRATION

A. The original Registration Certificate will be issued in the name of the person who was the recorded owner or recorded lessee of the dam at the time of foaling or in the name of the person designated by the recorded owner or the recorded lessee pursuant to Rule 2, Section 1-B, Paragraph B, or Rule 2 Section 1-D, Paragraph B or in the name of the last party listed on the ownership record on the Application for Frozen Embryo/Oocyte Transfer. (See Rule 2 Sections 1-C and 1-E).

B. A Registration Certificate is a certification of information contained in the records of the Registry.

C. The Registry will issue registration numbers in consecutive order, based on the order in which the applications are processed by the Registry.

D. Unless otherwise requested by the owners of a horse, any horse registered with the Registry that is owned by more than one owner shall be classified as being owned by Joint Tenants with Right of Survivorship.

If you have any questions, please contact the AMHA Registry Department at registry@morganhorse.com or (802) 985-4944 extension 2. Thank you.
