Standardized Language for COVID-19 Treatments

As mentioned in the FAFP 2023 Final Legislative Summary, the new Protection from Discrimination Based Upon Healthcare Choices Law (SB 252) requires that family physicians and advanced practice professionals obtain informed consent for medications used to treat COVID-19. The FAFP is providing its members the following sample language for use in practice to ensure compliance. While written consent on a separate, unique form is not necessary, informed consent cannot be verbal alone and must be documented in the patient's medical record.  The following language is a sample the FAFP suggests members use for documenting.

"I have discussed with the patient all current Emergency Use Authorization (EUA) or U.S. Food & Drug Administration (FDA) treatment options for COVID-19, including the risks, benefits, and alternatives for all authorized and/or approved medications. After learning about the efficacy and potential side effects of each medication, the patient and I (through a shared decision-making process) have agreed on the indicated treatment."
