Welcome to this edition of the CMDA E-Newsletter. It features industry updates and a number of association activities and reminders. You may now register for our upcoming July 7 Webinar on Auto Auction Updates & Strategies, the July 20 CMDA Past and Present Members' Reception at the NAMAD Annual Meeting, and the October 2-5, 2016 CMDA Summer Business Meeting in Napa Valley, California. Please also consider signing up to participate in our Dealer for a Day Teen Mentoring Program and/or the Minority Service Technician Summer Internship Program.
We are pleased to report that the new CMDA Board of Directors visited FCA Headquarters in Auburn Hills on May 23, 2016 and met with a number of FCA executives and personnel for a productive meeting. We discussed
issues of concern to CMDA members, including FCA's sales targets/vgp, inventory and parts availability, the need for accurate diversity data, and the importance of resource allocation to grow the number of ethnic minority dealers/dealerships.

- The attire for the Sunday evening Welcome Reception and Dinner Banquet is Business Casual.
- The attire for the Monday Lawn Croquet and Dinner Party is tennis shoes, white clothes, shirts with collars, slacks, shorts or skirts. Blue jeans, swimwear, short shorts and shoes with elevated heels are NOT permitted.
- There is complimentary overnight parking at the Resort.
- Mandatory Porterage / baggage fees and maid service fees will be assessed on your final bill.
- CMDA attendees will receive a 10% discount on Spa treatments.
- The Resort features The Restaurant at Meadowood, a Michelin Guide 3-Star restaurant. It suggests that diners make reservations several months in advance.
- Casual dining is available at The Grille Restaurant onsite. There is also a variety of restaurants located in the nearby little towns of St. Helena and Yountsville.
- A complimentary house car will take you to downtown Yountville and downtown St. Helena. Contact the front desk for availability.
- As a rule of thumb, leave the resort three hours before your commercial flight departs.

Service Advisor Overtime Ruling
In June of 2016, the case of
Encino Motorcars v. Navarro, the Supreme Court ruled in favor of the dealership which claimed its service writers are similar to car salesmen or mechanics who are exempt from overtime requirements under the Fair Labor Standards Act (FLSA).
According to the National Association of Auto Dealers (NADA), "in doing so, the Supreme Court expressly rejected a 2011 U.S. Department of Labor (DOL) interpretative regulation that service writers/advisors are not "salesmen" exempt from overtime. In particular, the Court faulted DOL for failing to give adequate weight to dealerships' reliance interests during the rulemaking process, and for failing to provide a "reasoned explanation" for the abrupt change of policy.
The Court's ruling is generally considered favorable for dealerships, but, wage and hour issues can be very complex. In recent years the DOL has been closely scrutinizing auto dealerships regarding compliance with "exempt" vs "non-exempt" overtime regulations. The best way to be sure you are following all laws regarding wages and hours, is to contact your tax attorneys. Their expertise will ensure you are in compliance before you are charged with unfair practices, or the subject of a DOL wage audit.

New Department of Labor White Collar Overtime Rule
Click here for a LINK to NADA's Frequently Asked Questions Memo on the new Department of Labor (DOL) white collar overtime rule. It provides an overview of how the rule will impact dealerships and their employees. NADA's Dealer Guide to the Fair Labor Standards and Equal Pay Acts, which describes how dealership employees generally qualify for the "white collar" overtime exemptions, will be revised to reflect the new mandates before the December 1, 2016, effective date. The Guide details how dealership employees generally qualify for the "white collar" overtime exemptions. NADA is also developing outreach materials on the rule's impacts on dealerships and their employees and is evaluating potential participation in potential litigation and Congressional oversight.

Following up on the success of last year's Dealer For a Day Mentoring Program, we will repeat this community initiative this June and August. CMDA will cover all of the expenses, handle all logistics and communication with your local Boys & Girls Club and provide all of the materials. Member dealers are asked to host 10-15 kids for
one day from 10:00 am to 3:00 pm during which time you will give them a tour of your facilities, show them the different careers within the dealership, have lunch with them in your conference room, and discuss your path to success and entrepreneurship.

Summer Internship Program
CMDA is assisting minority students attending automotive repair and certification schools with finding internship positions at dealerships during the summer. This is a great opportunity to assist minority youth and encourage vocational education and careers for deserving young people.

CMDA members receive $10,000 annually in training and consulting services reimbursement under the One Third Training Reimbursement Program. Members may expend up to $15,000 for training from approved vendors and CMDA will reimburse $5,000 of the expenses and FCA will reimburse $5000 of the expenses. The Dealer pays the final $5,000. Event Spotlight: Neuwirth Motors Inc. (NC) Carolina Beach Go Topless Jeep Event - A Mega Success |
CMDA Secretary and Member
John Gillilan's Neuwirth Motors dealership in North Carolina held a super successful
2016 Carolina Beach Jeep Go Topless event on May 14. The annual family and community event was organized by his son Matthew
and even raised food donations for the Carolina Beach Help Center.
More than 510 Jeep Wrangler owners participated this year. The word of mouth excitement for the event really spread as the only advertising
was a Facebook page and mention on some Jeep Forums. The local
sheriff's department provided highway traffic control escorts for the big jeep convoy to Carolina Beach.
Participants traveled from across North Carolina and other states including Virginia, Tennessee, Georgia and South Carolina. At least one attendee traveled all the way from Arkansas, which was approximately 1000 miles. The Jeep catalog and parts distributor 4WD Hardware came this year and promoted the event on its Facebook page. John anticipates an even larger crowd next year. Jeep Go Topless Day is a nationwide event promoted by Jeep across the whole country in the month of May and any dealer can participate.
