Supreme Court Roundup

With outside temperatures nearing record highs, current event topics are just as hot. Emergency docket rulings on nationwide injunctions relating to birthright citizenship, removal of noncitizens under the Alien Enemies Act, DOGE access to Social Security records, disqualification of transgender military service members, deportations of immigrants to foreign prisons, firings of probationary federal employees, termination of federal education grants, and other temporary, provisional decisions made headlines in the past few months.


On the regular merit docket were decisions on religious opt-outs from public school lessons, state bans on some forms of transition care for transgender youths, burden of proof requirements for majority group members claiming workplace discrimination, state sponsorship of religious charter schools, tax exemption eligibility for religious charities, and immunity of gun manufacturers from liability to Mexico for drug cartel violence.

MARTIN FLAHERTY is the Leitner Family Professor of Law and Founding Co-Director of the Leitner Center for International Law and Justice at Fordham Law School. He is also a Visiting Professor at the Woodrow Wilson School of Public and International Affairs, Princeton University, where he was Fellow in the Program in Law and Public Affairs. Professor Flaherty has taught at Cardozo School of Law, Columbia Law School, the New School, New York Law School, and St. John's University School of Law. Flaherty received a BA from Princeton, an MA. and MPhil in history from Yale, and a JD from Columbia Law School He clerked for Hon. John J. Gibbons, US. Court of Appeals for the Third Circuit, and Hon. Byron R. White, US Supreme Court.
