ABA Section of Dispute Resolution 2021 Mediation Institute
November 4 - 6, 2021

This three-day virtual Institute features the opportunity to learn from some of the leading authorities in the field.

This year's theme is "Mediation Beyond Boundaries: Competencies and Ethics in a Digital World". An exploration of new mediation frontiers in a post-pandemic world of technologies and innovations.

Two plenary sessions will be presented daily with each followed by small group break-out discussions allowing participants to interact in depth with the faculty and each other. Advocates and Mediators alike should not miss it!
TAPM WEBINAR ON TRANSFORMATIVE MEDIATION

If you didn’t have a chance to attend TAPM’s July webinar on Transformative Mediation here are some key takeaways on transformative interventions by a mediator. In a mediation, think about when to intervene (or not):

·        Reflect back: says back to a party what they just said, using language close to what they said. Benefits include:
o  the party feels heard,
o  the party can clarify or decide what they want to say next,
o  it slows down the process, and
o  it helps the other party actually hear what was said – it’s said twice and the second time it comes from the neutral mediator.
·        Summarize: condense a series of themes that have emerged or what has happened thus far in the mediation; cover all the key points and do not strategically remove any key item. This can highlight the parties’ differences in the conflict and help them move to figuring out what they want to do about it.
·        Check-in: ask questions about the process – how are the issues being discussed, how are the parties interacting, e.g. “I’m just checking in, is this working for you?”
·        Back out: remain silent and allow the parties to talk with each other without interruption.

The Supreme Court has created a new and innovative plan called the TNSC ADR Plan. The ADR Plan addresses case backlogs related to the Covid-19 Pandemic http://www.tncourts.gov/adrplan. The Training PowerPoints are on the right-hand side of “Mediator Training Information.”
 
 
To be listed as a Rule 31 Mediator, you must submit a renewal application and renewal fee annually. 

A Rule 31 Mediator may complete ALL 6 (six) Biennial Continuing Mediation Education (CME) hours online. This 6-hour requirement is every 2 years.
 
If all requirements of a Rule 31 Mediator’s annual renewal have not been completed by March 31 of the renewal year, then the Rule 31 Mediator’s listing lapses. Rule 31, Section 15(b)
 
A mediator whose credentials have lapsed for failure to comply with CME requirements must re-apply to the ADRC for a listing and must have taken all required training per section 14.
