Q
& A
|
|
Q: Where can I find the minimum-services
requirements concerning presenting and negotiating offers? I
represent sellers and buyers and want to be sure that I am
complying with the law.
A: The Real Estate License Act contains
provisions that impose requirements on buyer's agents as well as
seller's agents concerning the presentation of offers and
negotiating transactions. For example, in most cases the buyer's
agent must send a copy of any offer to the listing broker, even if
the listing broker consents to the delivery of an offer directly to
the seller. In turn, the listing broker must answer a seller's
questions regarding any offer made to the seller and present any
counteroffer from the seller to the buyer.
Note: These minimum-services rules apply regardless of the
agreed-upon compensation payable to the broker.

Greetings!

The word is out.
Our elected officials will be facing an $18 billion budget deficit
when they convene in January for the legislative session. Sound
alarming? I'd say so. Even more alarming is what that could mean
for Texas REALTORS.
Take for example a new sales tax on real estate. One newly elected
official ran their entire campaign pushing for such a tax, calling
it "true homeownership." In fact, such a proposal would need to tax
property sales at 20% to offset the overreliance of property taxes.
This type of tax is merely swapping one real estate tax for
another, adding an even greater deterrent to homeownership. And
what do you think taxing real estate would do to your bottom line
and to your pocketbook?
In today's recovering economy we need to be moving forward, not
taking a step back. A sales tax on real estate would move us in the
wrong direction, causing more than $1 billion in forgone economic
activity and over 230,000 lost jobs in Texas.
Right now, Texas has a stable real estate market, unlike many other
states. Why? Because of a strong TREPAC. But we need your help to
continue fighting bad policies that will harm our industry and
overall economy. By making your investment you are investing in
your business. So won't you join me today by investing in TREPAC!
You can do so online at www.TexasRealtors.com/trepac or through the
Temple-Belton Board of REALTORS. Your business and your clients
depend on it.
Now, please let me bring your attention to some local Association
issues and upcoming events:
1. A notice has been placed on Paragon making you aware of the
updated MLS Policies and Infraction Citations. I would like to make
you aware that the MLS Committee will be devoting the remainder of
this year to the enforcement of ALL MLS Policies. Please be
advised!
2. I am encouraging you, as a Member of TBBOR, TAR and NAR, to
take advantage of some exciting opportunities. You will meet great
contacts over the state and nation. You will be privy to all the
newest issues and technology.....and being allowed to do so at two
awesome venues:
The Texas Association of REALTORS Convention & Trade Expo
Galveston
September 13-15, 2010
The National Association of REALTORS Conference & Expo
New Orleans
November 5-8, 2010
3. Our Social & Special Events Committee worked diligently
to schedule Douglas Oldmixion, Administrator of the Texas Real
Estate Commission (TREC) as the guest speaker at the August
Membership Luncheon. I hope you take advantage of this rare
opportunity to meet him in person and hear his presentation. Please
RSVP.

Education
and Opportunity Abound at the 2010 TAR Annual
Convention
Are you in need of some inspiration
and motivation to get your business back on track? The Texas
Association of REALTORS Annual Convention and Trade Expo in
Galveston, September 10-15, might be just the thing you need to
stay up in today's market. From association governance meetings to
a variety of activities and education opportunities, this year's
convention is sure to provide you with the tools you need to make
the remainder of 2010 a great success. Online registration at
TexasRealtors.com is open now. Select from the five registration
options offered and register by August 11 if you need hotel
accommodations.
With our state legislators soon to
face an $18 billion deficit, every Texas REALTOR should be looking
for information on how they can impact the upcoming November
elections and 2011 legislative session. You can start by attending
the Public Policy Committee/Forum on September 10 from 1-3 pm. The
meeting will not only cover state issues but for the first time
will feature a federal issues forum hosted by NAR's Deputy Chief
Lobbyist, Jaime Gregory, to keep you up to date on all of the
changes coming from Washington, D.C.
If inspiration and motivation are
what you need, the September 13 Opening Session is sure to deliver.
In a powerful presentation, Rick Rigsby will explore the attitudes
and tendencies of great people and how they approach work and
leisure. Rigsby wowed TAR leaders during the 2009 Board Officers
Leadership Conference and is sure to do the same for you this
September.
As quickly as this industry is
changing, every Texas REALTOR can use a little extra education.
The annual convention is a great opportunity to experience new MCE
offerings that might not be found in your area back home. This
year, we are delivering 25 sessions that offer over 50 hours of MCE
and cover everything from "How Not to Get Sued and Stay Out of
Jail" to the newest in Social Media marketing and working through
REO properties. A complete list of Education offerings can be found
at TexasRealtors.com.
We hope you will join us for what is sure to be an exciting and
informative convention. Please remember to register online before
August 11 if you are in need of hotel accommodations in Galveston,
as the rooms fill up quickly.
