Q & A
Q: Where can I find the minimum-services requirements concerning presenting and negotiating offers? I represent sellers and buyers and want to be sure that I am complying with the law.
A: The Real Estate License Act contains provisions that impose requirements on buyer's agents as well as seller's agents concerning the presentation of offers and negotiating transactions. For example, in most cases the buyer's agent must send a copy of any offer to the listing broker, even if the listing broker consents to the delivery of an offer directly to the seller. In turn, the listing broker must answer a seller's questions regarding any offer made to the seller and present any counteroffer from the seller to the buyer.

Note: These minimum-services rules apply regardless of the agreed-upon compensation payable to the broker.

The word is out. Our elected officials will be facing an $18 billion budget deficit when they convene in January for the legislative session. Sound alarming? I'd say so. Even more alarming is what that could mean for Texas REALTORS�.

Take for example a new sales tax on real estate. One newly elected official ran their entire campaign pushing for such a tax, calling it "true homeownership." In fact, such a proposal would need to tax property sales at 20% to offset the overreliance of property taxes. This type of tax is merely swapping one real estate tax for another, adding an even greater deterrent to homeownership. And what do you think taxing real estate would do to your bottom line and to your pocketbook?

In today's recovering economy we need to be moving forward, not taking a step back. A sales tax on real estate would move us in the wrong direction, causing more than $1 billion in forgone economic activity and over 230,000 lost jobs in Texas.

Right now, Texas has a stable real estate market, unlike many other states. Why? Because of a strong TREPAC. But we need your help to continue fighting bad policies that will harm our industry and overall economy. By making your investment you are investing in your business. TREC is the state's regulatory agency for the following:
Real Estate Brokers and Salespersons, Real Estate Inspectors, Education Providers for Real Estate and Inspection Courses, Residential Service Companies, Timeshare Developers, and Easement Or Right-of-Way (ERW) agents

TREC exists to protect and serve the citizens of Texas. The Commission's programs of education, licensing and industry regulation ensure that real estate service providers are honest, trustworthy and competent.

TREC requires that all real estate brokers and salespersons meet and maintain specified levels of education to hold a license to act as a real estate agent. Agents are required to follow the provisions of The Real Estate License Act and the Rules of the Texas Real Estate Commission in all transactions and to deal with the public in a competent and honest manner.

Are you in need of some inspiration and motivation to get your business back on track? The Texas Association of REALTORS� Annual Convention and Trade Expo in Galveston, September 10-15, might be just the thing you need to stay up in today's market. From association governance meetings to a variety of activities and education opportunities, this year's convention is sure to provide you with the tools you need to make the remainder of 2010 a great success. With our state legislators soon to face an $18 billion deficit, every Texas REALTOR� should be looking for information on how they can impact the upcoming November elections and 2011 legislative session. You can start by attending the Public Policy Committee/Forum on September 10 from 1-3 pm. The meeting will not only cover state issues but for the first time will feature a federal issues forum hosted by NAR's Deputy Chief Lobbyist, Jaime Gregory, to keep you up to date on all of the changes coming from Washington, D.C.
