DOES YOUR COUNTY HAVE RCV-CAPABLE EQUIPMENT?

One of the major talking points for or against Ranked Choice Voting concerns equipment readiness. According to a 2023 RCV Resource Center State Readiness Assessment for Texas:

• Counties using ES&S DS200, DS450, DS850, AutoMARK, ExpressTouch, and/or ExpressVote equipment: Single-winner and proportional RCV ballots can be designed, scanned, and captured in this system. While this data can be captured by these systems, ES&S is currently limited to tabulating the RCV round-by-round count for single-winner RCV. This feature is available through its separate tabulation module, ExpressRunoff, provided a jurisdiction has the necessary software upgrades. For proportional RCV, cast vote records (CVRs) will need to be exported and run through third-party tabulation software to determine the winners in an RCV race. RCVRC’s RCTab software can run the round-by-round count on CVRs exported from this hardware as-is for RCV results for both single-winner and proportional RCV.74 Dominion equipment can produce a ballot with both RCV and non-RCV contests (but Dominion is not certified in Texas). Ballots are limited to a total of 10 rankings on a grid-style ballot.


Counties using the legacy (the previous generation) ES&S equipment, Model 100, Model 650, AutoMARK, and/or iVotronic. This older equipment can scan RCV ballots but does not export a cast vote record (CVR), making software-assisted counting of RCV elections impossible if using this hardware. Counties using this equipment either need to replace their equipment or hand count their RCV elections (possible in smaller elections).

• Counties using Hart Intercivic Verity Scan, Verity Central, Verity Duo, Verity Touch Writer, and/or Verity Touch equipment: Single-winner and proportional RCV ballots can be captured in this system, provided a jurisdiction has Hart’s RCV options enabled in its system. While the data can be captured by these systems, Hart systems do not have the ability to tabulate the RCV round-by-round count. Cast vote records (CVRs) will need to be exported and run through third-party tabulation software to determine the winners in an RCV race. RCVRC’s RCTab software can run the round-by-round count on CVRs from this hardware. Hart equipment can produce a ballot with both RCV and non-RCV contests. Depending on the software version in use, ballots are limited to five or six rankings on a grid-style ballot. In order to use this Hart equipment to run an RCV election from end to end, additional testing and software will be required.


 Counties using Hart Intercivic legacy (the previous generation) voting systems cannot administer RCV: Ballot Now, eScan, and/or eSlate equipment. This older equipment can scan RCV ballots but counties using Hart cannot export a cast vote record (CVR), making software-assisted counting of RCV elections impossible if using this hardware. For these counties, we recommend purchasing new equipment or moving to hand counting their RCV elections (possible in smaller elections). Hand counting RCV elections can be time-consuming. It is dependent on the length of the ballot and the number of votes cast, the latter of which is unknown until after the election.

Keep in mind that President Trump’s 03/25/2025 Executive Order on Preserving and Protecting the Integrity of American Elections sets new standards for improving the security of voting systems, which may cause many Texas counties to be looking at new equipment in the near future!

THIS WEEK'S BILL SPOTLIGHT:

SB396 Kolkhorst / HB4253 Gerdes

As Texas law exists today in Section 15.051 of the Election Code, a voter registrar must send a confirmation notice to a voter if the registrar notices that voter's registration address is a commercial post office box (as added by Senator Bettencourt's S.B. 1111 in 2021), or if the registrar has any reason to believe the voter's current residential address is different from that indicated on records. If a voter does not properly respond to the confirmation notice they are placed on the Suspense List and marked with an "S" next to their name. They are unable to cast a ballot without proving residence using a form described by Section 15.054.


In addition to this procedure, S.B. 396 would require a voter registrar to send a confirmation notice to a voter who on November 30 following a general election had not voted in the previous 25 months. This would mirror Ohio legislation, in that in that it would cancel the registration of a voter who failed to respond to a confirmation notice and who has not voted or updated the voter's registration two general elections occurring after the confirmation notice was mailed. The language of S.B. 396 follows closely that of Ohio, which was upheld by the United States Supreme Court in Husted vs Randolph Institute argued before the court in 2018. 

Key Provisions

• Requires the voter registrar to send a confirmation notice to all voters who on November 30 of an even-numbered year had not voted in the previous 25 months.

• This bill will require registrars to follow Chapters 15 and 16, Election Code, regarding the suspension and removal of voters who do not respond to confirmation notices.


As proposed, S.B. 396 amends current law relating to confirmation of a voter's residence by a voter registrar. 


Senator Lois Kolkhorst’s S.B. 396 was engrossed by the Senate on April 1st and referred to the House Elections Committee on April 9th. The companion bill, H.B. 4253 by State Rep. Stan Gerdes, is scheduled for a public hearing in the House Elections Committee this week, on April 17th.  State Rep. Matt Morgan also filed duplicate companion bill, H.B. 2272.
