In the first story of the morning, the Texas Propane Gas Association reminds those affected by Hurricane Beryl that a waiver is in effect for the impacted counties.


On a separate note, for the past several years, the U.S. DOT has attempted to adopt a federal regulation requiring commercial motor vehicles over 26,001 GVWR to install speed limiters. Read our second story of the day for an update on this regulation.

Hurricane Beryl: Texas Hours Waiver Still in Effect

Over the July 4th holiday weekend, Dan Patrick, Acting Governor of the State of Texas, issued disaster proclamation(s) certifying that Hurricane Beryl poses a threat of imminent disaster, including widespread and severe property damage, injury, and loss of life due to possible widespread flooding, life-threatening storm surge, damaging wind, and heavy rainfall.


Pursuant to 49 CFR 390.23, an emergency declaration issued by the Governor of a state automatically triggers the suspension of hours-of-service limitations outlined in 49 CFR 395.3 for 14 days for select counties in the path of the Hurricane. The Acting Texas Governor's latest disaster declaration was issued on July 6, 2024, and hours-of-service limitations will be waived for 14 days thereafter while responding to these potentially affected counties.

Federal Speed Limiter Mandate Delayed Until 2025

The Federal Motor Carrier Safety Administration (FMCSA) has postponed the projected date for publishing a federal rule that would require speed limiter devices on commercial vehicles over 26,001 pounds.


According to the White House Office of Management and Budget, the speed limiter mandate has been rescheduled for May 2025. Previously, the target date for the release of this rulemaking was May 2024.


The FMCSA is preparing a supplemental notice of proposed rulemaking (SNPRM) to follow up on a jointly issued notice from the National Highway Traffic Safety Administration (NHTSA) and FMCSA in September 2016. This rule would mandate that commercial vehicles have an electronic engine control unit (ECU) capable of governing speed to a limit determined during the rulemaking process.


Despite the delay, the FMCSA has received thousands of comments from truck drivers expressing concerns about potential road rage and safety issues. The debate continues as stakeholders await the final details of the mandate.
