What are the Railroad Commission's Serious LP Gas Safety Violations?

The Railroad Commission of Texas recently shared with us the following LP Gas Safety Rules, which can be considered a serious violation. It may result in a warning letter or trigger the administrative process that often results in a fine:

  • Distance violations. NFPA 58 §6.4 through §6.5 and LP-Gas Safety rule §9.142(1)
  • Coverings over containers. LP-Gas Safety rule §9.141(f)
  • Licensing and decal violations LP-Gas Safety rule §113.081, §9.132 and §9.202.
  • School Pressure test requirements. LP-Gas Safety rule §9.41.
  • Disabled or bypassed safety devices LP-Gas Safety rule §9.143

Standard violations may become serious violations if they occur multiple times. i.e., Violations that show a pattern of behavior.

A combination of violations may become a serious violation. Several minor violations that, as a whole, cause a serious situation may be considered a serious violation.

This is not an exhaustive list, and the priorities of the RRC leadership may shift over time.

RRC Propane Compliance Installation Checklists

Below are links 🔗  to checklists created by the Railroad Commission that are provided as guidelines for assisting LPG licensees in complying with state statutes, the Commission's safety rules, and adopted national and federal codes specific to each installation type.

These checklists are not intended to be a definitive or exhaustive listing of all statutes, safety rules, regulations, or codes that may be applicable but help.

Do You Have the Latest Version of the ERG in Your Propane Delivery Vehicles?

The Pipeline Hazardous Material Safety Administration (PHMSA) of the U.S. Department of Transportation produces the Emergency Response Guidebook (ERG) every four years as a critical resource for first responders dealing with hazmat transportation accidents within the crucial first 30 minutes. The ERG tells first responders how to quickly identify hazardous materials, their health and safety risks, and what action they should take at an incident.

The latest edition, the 2024 version, is now available through the Propane Service Corporation to help the propane industry meet the requirements of 49 CFR 172.602 of the Hazardous Material Regulations (HMR) and carry them in the glove compartments of our bobtails and transports.

"To increase the likelihood that emergency response information will be available to first responders at the scene of a hazardous materials incident, the Hazardous Materials Regulations require that emergency response information accompany most shipments of hazardous materials," writes Truckinginfo.com in an online article the Purpose of the Emergency Response Guidebook.

"Carriers that transport hazardous materials must maintain the emergency response information the same as they do shipping papers. The emergency response information must be readily available to and recognizable by authorities in the event of an incident or inspection," Truckinginfo.com says in its online article, the Purpose of the Emergency Response Guidebook.
