Question:
I have a tenant who is 45 days past due. I seized the unit in the process of doing my foreclosure steps. When I opened the unit, I found a refrigerator with no motor on it and a broken-down desk. I think that this is worthless trash. Can I throw these items in the dumpster?
Answer:
What you may view as trash has a tendency to become someone else’s treasure as soon as you throw it away. This situation probably meets one of the definitions of “abandonment” under the TSSA lease. One of the definitions of abandonment is: (1) the tenant has not paid rent or other sums due, (2) the tenant’s lock has been removed by someone other than the Lessor, or by the Lessor when exercising a statutory seizure, and (3) the tenant’s space contains nothing of value to the ordinary person. You certainly meet condition #1 and condition #2, and it is usually condition #3 that tenants have the potential to argue about. To be extra cautious and give yourself a little extra “insurance," TSSA Legal Counsel would recommend taking a picture of the contents of the unit for your records and then sending the “Notice of Abandonment," form MISC-3, which can be found on the TSSA

© Appendix CD [for the moment—CD is being discontinued] and in the "Members Only" section of the TSSA website. This notice of abandonment form notifies the tenant that you consider his items abandoned, and that unless he notifies you by a certain date, you will dispose of the items. You are not legally required to send this notice of abandonment, but again it is good “insurance”—as the tenant would be hard-pressed to argue that his items were worth thousands of dollars if he did not even bother to respond to your notice of abandonment.
