If a tenant has a vehicle/trailer/boat in an enclosed unit, and that tenant files bankruptcy, can the facility move the vehicle to a less expensive outdoor parking space?
Answer:
No, I would not recommend that you do this. When a bankruptcy is filed, everything “freezes,” so to speak, until (1) you reach agreement with the tenant or the bankruptcy trustee, (2) you are granted a lift of the bankruptcy stay, or (3) the bankruptcy case is dismissed or closed. I would recommend that you call the bankruptcy attorney (or if it is a Chapter 7 case, the trustee) and try to reach a settlement.
