Illinois General Assembly
The House and Senate are not scheduled to return to Springfield until the fall veto session. The House and Senate have not posted the fall veto session dates. My understanding is that it will be after the November elections.
Rulemaking
The May 20 edition of the Illinois Register did not contain any proposed or adopted rulemakings by the Department of Commerce and Economic Opportunity or adopted rulemaking by the Department of Revenue.
The Department of Revenue proposed an amendment to the Retailers' Occupation Tax rules. The Department described the rulemaking as follows:
"This rulemaking amends Section 86 Ill. Adm. Code 130.905 Interest to update the application of interest to unpaid tax due under the Retailers’ Occupation Tax Act, on and after January 1, 2001, to conform with the current language of the Uniform Penalty and Interest Act [35 ILCS 735/3-2(c-5)]. Interest, on and after January 1, 2001, is to apply to tax only, not to any penalty."
Court cases
No new cases this week.
Tax Tribunal
No new decisions have been posted by the Tribunal this week.
None of the new cases raise unique issues. The new cases consist of a request for penalty abatement for late payment of prepaid sales taxes on motor fuel, two protests of personal responsibility penalties and a residency case.
Illinois Department of Revenue
The Department issued a series of Informational Bulletins this week.
Informational Bulletin FY 2022-24 - State Sales Tax Holiday August 5, 2022, through August 14, 2022. "The state sales tax holiday is a ten-day period during which consumers can purchase certain clothing and school-related items and pay sales tax at a reduced rate. The state’s portion of sales tax due throughout the holiday is reduced by 5 percent (5.00%) from 6.25 percent (6.25%) to 1.25 percent (1.25%)."
