Attorney General Becerra Publicly Releases Proposed Regulations under the California Consumer Privacy Act
October 10, 2019
California Attorney General Xavier Becerra released to the public proposed regulations under the California Consumer Privacy Act (CCPA). The CCPA was introduced as Assembly Bill 375 and signed into law on June 28, 2018. The law provides consumers with groundbreaking new rights on the use of their personal information. The law mandates that on or before July 1, 2020, the Office of the Attorney General promulgate and adopt implementing regulations for the CCPA. The comment period regarding these proposed regulations has now begun.

Washington Attorney General Ferguson Suit Puts Company That Scammed Foreclosed Homeowners Out of Business
October 16, 2019
Attorney General Bob Ferguson announced that, as a result of his lawsuit, Kirkland- and Portland-based Real Estate Investment Network, LLC (REIN) will be required to dissolve and pay up to $85,000 for scamming foreclosed homeowners out of equity in the form of surplus funds remaining after the sale. These surplus funds can amount to tens of thousands of dollars.

Oregon Attorney General Rosenblum Sues Washington Company for Deceptive Marketing Practices
October 16, 2019
Attorney General Ellen Rosenblum filed a lawsuit against the Vancouver, Washington company U.S. Air Ducts, its owners and their associated companies for violating Oregon’s Unlawful Trade Practices Act (UTPA) by using deceptive marketing practices to make over 11 million unwanted robocalls to Oregon phone numbers and sending 20 million print advertisements promising a “whole house” or “seasonal” cleaning at a special price. Once in the home, commission-based sales people would use high pressure sales tactics to get consumers to spend hundreds of dollars, or more, for a complete cleaning, a fake VIP membership and services the company was not able to perform.

Attorney General Becerra Issues Consumer Alert on Price Gouging Following State of Emergency in Los Angeles and Riverside Counties
October 11, 2019
California Attorney General Xavier Becerra issued a consumer alert following the Governor’s declaration of a state of emergency in Los Angeles and Riverside Counties due to several fires, including the Saddleridge, Eagle, Sandalwood, Reche, and Wolf fires. Attorney General Becerra reminds all Californians that price gouging during a state of emergency is illegal under Penal Code Section 396.

Montana Department of Justice Hires Human Trafficking Enforcement Team
October 15, 2019
Attorney General Tim Fox announced the Montana Department of Justice (DOJ) has hired two full-time agents who will work solely on human trafficking investigations. The team, based in Billings, is employed by DOJ’s Division of Criminal Investigation (DCI) and will work on cases of suspected human trafficking statewide.

Arkansas Attorney General Rutledge Sues Three Online E-Cigarette Retailers for Selling to Children

Arkansas Attorney General Leslie Rutledge is taking legal action against three online e-cigarette retailers for violating State laws. By selling and shipping nicotine products and devices, including e-cigarettes, to Arkansas children without age verification, the companies are in violation of the Arkansas Deceptive Trade Practices Act (ADTPA).

States, Not Feds, Should Oversee Sports Betting

With the NFL season in full swing, it’s important to recognize the role states have played in deciding whether to legalize sports betting.
sports betting illustrationSince the Supreme Court paved the way for legalized sports betting, 13 states actively operate legal sports betting marketplaces, while several other states have legalized sports wagering and plan to get their systems up and running soon.
States are best positioned to determine what the rules and regulations of a legal sports betting marketplace should look like to fit their specific states.
