SB 9 & VERY HIGH FIRE HAZARD SEVERITY ZONES
Last week, California Governor Gavin Newsom and Los Angeles Mayor Karen Bass issued separate but coordinated executive orders to address rebuilding efforts and fire safety concerns following the recent Palisades and Eaton Fires. These orders focus on regulating development under Senate Bill 9 (SB 9) within the designated burn areas.
Governor Newsom’s Executive Order N-32-25 provides the foundational authority for local action. In response to concerns from local officials and community members about the potential for new SB 9 developments crowding evacuation routes, the Governor’s order suspends the application of SB 9 in very high fire hazard severity zones within the Los Angeles County burn scars.
This action covers areas including the Palisades, Altadena, Sunset Mesa, and Malibu. The order grants local governments the discretion to either suspend SB 9 completely or to implement their own standards, such as adding additional mitigation requirements. The Governor’s order also includes a seven-day pause on SB 9 applications in the specified zones to allow time for local governments to develop their specific regulations.
This executive order is part of a larger state effort to support safe and swift community recovery and will remain in effect as long as the state of emergency is active.
