FAQ: Towing A Tenant's Car Examining Your "Abandoned Vehicle" Policy Question: I have a tenant who has parked an inoperable vehicle in my parking lot. This is a clear violation of his lease agreement and we called the tenant repeatedly about his car and he did nothing. Earlier in the week my courtesy officer "tagged" the car and this morning we had it towed. This afternoon I received a call from Legal Services threatening to sue because I did not follow the "abandoned vehicle towing statute". Is there really such a thing? Answer: The relevant state law that applies to this situation is Alabama Code 32-13-4. It states that a car that has an expired license plate or is inoperable in a parking area of an apartment community or other private property that is leased or made available to tenants, residents, and guests is considered "abandoned" after a period of 30 days or more. After that period of time has elapsed, the property manager can post a dated notice in a conspicuous place on the vehicle in question stating that the vehicle has been determined to be abandoned or inoperable and will be removed at the direction of the property owner in seven calendar days from the date of the notice. That notice should include the name and address of the last registered owner of the vehicle and the name and address of the property manager and should also be mailed to the last registered owner of the vehicle. At the expiration of the seven days the property manager can contact a towing company and have the car towed at which point the last registered owner of the vehicle will be responsible for the costs of the tow and any lien the towing service may have on the vehicle. Please note that within 24 hours after removing the abandoned vehicle, the property owner should give written notice to law enforcement that they have removed the vehicle from the property. The property manager is liable to the owner of the motor vehicle only for gross negligence under this statute. I understand that this is a burdensome process - but abiding by the requirements of the towing statute is a clear way to avoid a pesky call from Legal Services of North Alabama! |

Attorney Spotlight
Sarah Leopold Taggart graduated from Lee High School in Huntsville, Alabama and attended the University of the South in Sewanee, Tennessee. Eviction Update:
There is a backlog at the Sheriff's office regarding set outs. Part of the backlog is due to the fact that there were no set outs in December. The remainder of the backlog is due to the inclement weather. The Sheriff's office is not allowed to do set outs when there is snow on the ground or more than a 30% chance of rain. We have found that when you schedule a set out it is completed quicker if you take the "first available appointment" than when you schedule a specific date.

I hope that everyone had a great start to 2011! We are approaching the 2nd quarter of the year, and leasing season. Please keep in mind the billing policies set by Sarah Taggart, P.C. All invoices are due in 30 days and we reserve the right to cease action on your case if you have invoices that are at least 60 days late. If you are experiencing financial difficulties please let us know ahead of time. We are more than willing to work with you as we are well aware of the current economic conditions. As many of you know, we extend credit to our clients with good payment histories. However, our ability to do so will be hindered if we continue to have a surplus of past due invoices. Please help us to help you by getting invoices paid on time. If you would like to request invoices prior to filing please let me know, and I will make it happen.We make it our business to ensure that our clients are happy and we want to meet the needs of each and every one.
