Bipartisan Budget Finally Passes
In the wee early hours Thursday morning, the State Legislature passed a bipartisan $18 billion budget after a lot of negotiating. Just in time. The passage comes one week before the deadline avoiding a partial state government shutdown.
The budget includes increases to K-12 school spending, university funding, expansion of the Empowerment Scholarship Account and for the Secretary of State to run the 2022 elections. The budget also contains paying down pension debt ($1 billion), investing in water infrastructure ($1 billion over three years), $500 million for border security and getting rid of the state equalization tax rate.
It’s now up to Governor Ducey to sign the budget bills (which he supports) before July 1.

Delayed Effective Date on Dog Breed Discrimination Law
House Bill 2323 Homeowner's Insurance; Dogs; Nondiscrimination was signed into law by Governor Ducey last month. This bill specifies that the breed of a dog may not be the sole factor considered or used for underwriting or actuarial processes for determining risk, liability or claim losses for dogs on homeowners' or renters' insurance policies. It goes on to state the breed of a dog may not be the sole factor considered or used on any questionnaires, surveys or other means of gathering information regarding ownership or possession of a dog or the presence of a dog on premises insured or to be insured under a homeowner's or renter's insurance policy.
The bill defines the terms of "aggressive", "vicious", "provocation", and "breed" under ARS 11-1025 Liability For Dog Bites and prohibits the breed of a dog from being considered in legally determining whether a dog is aggressive or vicious or has created liability for a dog bite.
The legislation has a delayed effective date of July 1, 2023. It applies only to homeowners' and renters' policies issued or renewed on or after July 1, 2023. The delayed implementation gives insurance companies time to get policy language adjusted, underwriting guidelines changed up and decisions made about moving forward.
We will be releasing more information on how these changes impact producers when we have those details from the insurance companies. In the meantime, nothing has changed for homeowners' and renters' policies on inquiring about the breed of a dog until the law becomes effective next Summer.

Flooding After Wildfires
2022 is shaping up to be another very active wildfire season and monsoon rains will no doubt once again cause catastrophic flooding along the wildfire burn scars. Concerned about possible flooding, the City of Flagstaff sent out a notice last Friday to residents about the need to purchase flood insurance for areas impacted by the Pipeline Fire.
FEMA has recently released a toolkit to bring awareness to the risks of flood after wildfires and the need for flood insurance. These materials including graphics and talking points are available for insurance producers to utilize in social media, websites, blogs and mailers.
Remember, the NFIP usually has a 30-day waiting period from date of purchase until the flood insurance policy goes into effect. However, there are exceptions including a Post-Wildfire exception and coverages may be expedited with reduced waiting periods.

New ADOT Auto Insurance Reporting Platform
ADOT Motor Vehicle Division's Mandatory Insurance Reporting System started transitioning over to the Arizona Insurance Verification System (AZIVS) on June 7, 2022.
This transition requires all insurance companies authorized to sell motor vehicle liability insurance to register with the new system by July 19th. Testing phase starts September 1st with production movement deadline on November 7, 2022.

Mistakes may happen. If an insured is inadvertently missed on an insurance company report, they may go to their AZMVDNow account and go through self certification. This process allows the insurance company a short window for the policy to be reported which will correct the driver's record. They can follow the instructions on the notice they receive from MVD, or they can visit any MVD location or authorized third-party office.
